RESOLUTION ORDERING VACATION OF A PUBLIC STREET
WHEREAS, pursuant to Resolution of Intention No. 752--D,
on file herein:, a public hearing was held at 2 00 p.m. on
the 3rd day of April, 1979, at a regular Fleeting of the
Council of the City of Fresno in the Council Chambers of
the Fresno City Hall in the City of Fresno, County of Fresno,
State of California, at which time and place evidence was
heard, for and against the vacation of a portion of , Forkner
Avenue, north of W. Shaw Avenue; and
WHEREAS, the City Traffic Engineer has reviewed the pro-
posed vacation action and determined that it will have no
adverse effect upon traffic circulations and
WHEREAS, findings of Environmental Assessment No. 2159
indicate that the proposed vacation action will have "no
possibility of significant effect on the environment". and
WHEREAS, the Council of the City of Fresno now finds
from all the evidence submitted that such street, hereinafter

NOW r THEREFORE, THE COUNCIL OF THE CITE` OF FRESNO
pursuant to the provisions of the "Street Vacation Act of
1941", being Sections 8300- 8374 of the Streets and Highways
Cade of the ,State of California, DOES HEREBY RESOLVE AS
FOLLOWS:
1.. The public interest and convenience require, and
it is hereby ordered, that as contemplated by Resolution of
Intention. No: 752-D adopted by the Council of the City of
Fresno on the 13th day of March, 1979, the vacation of a
portion of N. Forkner Avenue, north of W. Shaw Avenue,
situated in the City and. County of Fresno, Ibe and the same
is hereby closed:, vacated and abandoned for public street
purposes For further Particulars as to the proposed
vacation, reference is hereby made to the map Ientitled "Map

Attached to Resolution of Intention No. 752-D," on file
in the Office of the City Clerk of the City of Fresno, at
the Fresno City Hall, 2326 Fresno Street., Fresno, California
93721, and by this reference, made a part hereof.
2. That the City of Fresno intends to reserve and
except from the proposed vacation the permanent easement
and right at any tune, or from time to timer to construct, -
maintain, operate, replace, remove, and renew sanitary
sewers and storm drains and appurtenant structures beneath,
in, upon, over and across the following described parcels
of the street proposed to be vacated;
PARCEL
The South 15.00 feet thereof.
PARCEL ` B
FOR REFERENCEF BEGINNING at the Southeast corner of
said Section 7 thence North 890 16' 30" West,' alone
the South line of said Section'7, a distance of 1.83378
feet;.thence North 000 43' 30 East, a distance of
60.00 feet hence South 89n' 16' 30" East, parallel
with. the South line of said Section 7, a distance of
617.41 feet; thence Easterly and. Northerly, along a
tangent curve, concave to the Northwest and having a
radius of 30.00 feet, through an interior angle of
900 00' 0011, an arc distance of 47.12 feet to the
intersection with the West might -of -way of the realign-
ment of said North Forkner Avenue; thence North 000 43'
30" East along the West right-of-way line of the realign-
ment of said North Forkner Avenue, a distance of'109.80
feet, thence Northerly and. Northwesterly along a
tangent curvet concave to the Southwest, and having a
radius of 125.00 feet, through an interior angle of
360 42' 1011, an arc distance of 80.07 feet; thence
Northwesterly along a reverse curve, concave to the
Northeast and having a. radius of 682.27 feet,; through
an interior angle of 171 31' 29", an arc distance of
206.54 feet to the TRUE POINT OF BEGINNING: thence
continuing along said curve, concave to the Northeast,
and having a radius of 682.27 feet, -through an interior
angle of 010 20' 4011, an arc distance of 16.01 feet;
thence leaving said carve North 430 361 00" East, -a
distance of 14`.03 feet to the intersection with a
curve, thence Northwesterly along said curve, concave
to the Northeast, and having a radius of 694.77 feet,
an arc distance of 8 feet, more or less; thence
South 290 531 2311 East, a distance of 12.60 feet to
the intersection with_a curve, whose center bears
North 640 261 30" East; thence Southeasterly along
said curve, concave to the Northeast and having a
radius of 692.27 feet, through an interior angle of
000 51' 12", an arc distance of 10.34 feet; thence
leaving said curve South 430 361 00" West, a distance
of 15.93 feet to the TRUE POINT OF BEGINNING.
and, pursuant to any existing franchises or renewals, thereof,
or otherwise, to construct, maintain, operate, replace,

" remove, renew and enlarge lines of pipe, conduits, cables,
wires, poles, and other convenient structures, equipment and
fixtures for the operation of gas pipe lines, telegraphic
and telephone lanes, railroad lanes, and for the transporta-
tion or distribution of electric energy, petroleum. and its
products, ammonia, water, and incidental purposes, including
access and the right to keep the property free from flammable
materials, and wood growth, and otherwise protect the same
from all hazards beneath, in, upon, over and across the afore-
mentioned Parcels ".A" and "B" of the portion of this street
proposed to be vacated.
3. That the City of Fresno intends to reserve and
except from the proposed vacation a pedestrian walkway`
easement over and., across the following described parcel:
.A. portion of the realignment of North Forkner Avenue
as it now exists as of June 30, 1977 lying in Section
7, Township 13 South, Range 20 East, Mount Diablo Base
and Meridian., as said Section is shown on the United
States Township Plats and more particularly described
as follows:
FOR REFERENCE, BEGINNING at the Southeast corner of
said Section. 7; thence Forth 890 16T 30" Vest, along
the South line of said Section 7,a distance of
1833.78 feet'; thence North 000 43' 3011 East, a distance
of 60.00 feet; thence South. 890 161 3 011 East, parallel
with the South line of said Section 7, a distance of
640.41 feet to the point of curvature of a curve,
concave to the Northwest whose radius is 30.00 feet and
interior angle is 900 00' 00"; thence Northeasterly,
along said curve, through a delta angle of 761 56' 13",
an: arc distance of 40.28 feet to the True. Point of
Beginning; thence, continuing Northeasterly along said
curve, through a delta angle of 131 031 4711, an ' arc
distance of 6.84 feet to the point of tangency; thence
North 000 43` 30" East a distance of 9.49`feet to
point on a non -tangent curve, concave to the East, whose
radius is 11.00 feet and Interior angle is 951 29' 3111
(the radial, at said point bears South. 380 47' 461'
East) ; thence Southwesterly, Southerly, and Southeasterly,
along said curve, an arc distance of 18.33 feet to the
True Point of Beginning.
4,. That all proceedings for the vacation of such
street shall be and they are taken subject to the foregoing
reservations and exceptions.
5. The Council finds and determines that the rights
of war or parts thereof vacated are not useful as bicycle
paths or routes.
6. The City Clerk of the City of Fresno shall certify
to the passage of this resolution and shall cause a certified

City of Fresno, to be recorded in the Office of the County
Recorder of the, County of Fresno, ` State of California.
