RESOLUTION NO. 79- 11
A RESOLUTION OF THE COUNCIL CE THE CITY OF
FRESNO, CALIFORNIAr DETERMINING PUBLIC
CONVENIENCE AND NECESSITY OF PROPOSED
IMPROVEMENTS AND ACQUISITIONS REGARDING
CITY t3F FRESNO ASSESSMENT DISTRICT NO. 79
WHEREAS, on February 27, 1979, the Council, adopted
Resolution No. 79-81 preliminarily determining that the public
convenience and necessity require certain improvements and/or
acquisitions and proceedings without complying with the provisions
of the Special .Assessment Investigation, Limitation and Majority
Protest .Act of 1931; and
WHEREASf such Resolution did further fix Tuesday,
March 28, 1979, at the hour of 2:15 o'clock P.M... in the Council
Chamber, City Hall, 2326 Fresno Street, Fresno, California, as the
time and place when and where any interested person may object or
show cause why the Council should not finally find and determine
that the public convenience and necessity require that the
proposed work and improvements shall, be made, that the cast and
expense thereof shall be paid for by special assessments levied
upon the property within the district benefited thereby, and that
special assessment proceedings shall be taken therefor without
compliance with the Special .Assessment Investigations Limitation
and Majority Protest .Act of 1931 and
WHEREAS, it appears that such Resolution was duly
published as evidenced by the affidavits on file with the City
Clerk; and
WHEREAS, such: hearing was duly opened and held; and
WHEREAS, at such hearing all persons interested and
desiring to be heard were given an opportunity to be heard; and all
matters and things pertaining to the public convenience and
necessity of the improvements and the undertaking thereof by
special assessment and assessment Fond proceedings were fully
heard and considered by the Council:

NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND
ORDERED, AS FOLLOWS:
1. The following is a general description of the
proposed improvements to be constructed or acquired within the
proposed assessment district, the boundaries of which are more
particularly shown on the map on file with the Clerk of the City of
Fresno, designated Boundaries of City of Fresno Assessment
District No. 79s
Excavation and grading; removal of
street improvements where required; construc-
tion and installation of concrete curbs,
gutters, stepsr driveway approaches, side-
walks and retaining walls where required;
removal or relocation of sprinkler systems
where required; construction of valley
gutters, curb returns, alley approaches,
asphalt concrete pavement overlay and recon-
struction of streets where required; con-
struction of storm drainage facilities, in-
cluding storm drain pipelines, cross -drain
siphons, drain inlets, laterals, manholes,
and appurtenances; the doing of all transition
work and the construction and acquisition o
all improvements and rights -of -way auxiliary
to any of the foregoing and necessary to carry
out same in accordance with the requirements
of the City of Fresno,;
2. The public convenience and necessity require that
the proposed improvements be done and made, and that the Special
Assessment Investigation, Limitation and Majority Protest Act of
1931 shall not apply.
3. This resolution shall take effect and be in force
upon its adoption.
