RESOLUTION NO. 7 ,3 - 10 6
RESOLUTION VACATING EASEMENT ' FOR PUBLIC WATER MAID PURPOSES
WHEREAS, there is an easement for public water main pur-
poses in, upon, over and across the hereinafter described
strip of real property situated in the City of Fresno,
County of Fresno, State of California; and
WHEREAS, Superior Packing Company, the, owner of said
real property, h:�s requested that said public water main
easement be vacated; and
WHEREAS, Superior Packing Company, and the City of
Fresno have entered into a covenant agreement to guarantee
the relocation of the water main heretoforelocated within
said easement; and
WHEREAS, the City of Fresno has relocated said water`
main from said easement and that Superior Packing Company
has paid all casts of labor, materials, equipment and over-
head for such relocation in conformance with the recorded
covenant. agreement; and
WHEREAS, findings of Environmental Assessment No 1923
indicate that the proposed vacation action will have "no
possibility of significant effect on the environment" and
WHEREAS, all affected Departments and Public Utility
Companies have indicated that they have no objection to the
proposed vacation action, and
WHEREAS, the Council of the City of Fresno now finds
from all the evidence submitted that such easement is
unnecessary for present and prospective public 'water Main
purposes, and,
WHEREAS, the Councilof the City of Fresno desires to
vacate and abandon such easement;;
NOW, THEREFORE, the Council of the City of Fresno DOES
HEREBY RESOLVE AS FOLLOWS:

1. That the easement for public water main purposes
heretofore and now existing in, upon, over and across that
hereinafter described strip of real property situated
within the City and County of Fresno be and it is hereby
vacated and abandoned.
2. That the easement to be vacated is described as
follows 'y
All that portion of Villa Lot 15 of Dean Addition and
including a portion _ of South Second Street formerly
Dean Avenue which was vacated by Resolution.
Beginning at a point on North line of Lot 15 369.7
feet East of Northwest corner of Lot 13; thence 'South
parallel to West line of Lot 13, 318.5 feet;, thence
Nest parallel to South line, Lot 15, 20.0 feet; thence
North parallel. to West line, Lot 13, 318.5 feet to
North line of Lot 15 produced West; thence East 20.0
feet to point of beginning
Excepting the South 10.0 feet thereof.
3. The Council finds and determines that the ease-
ment or any parts thereof vacated are not useful as bicycle
paths or routes.
4. The City Clerk of the City of Fresno shall certify"
to the passage of this resolution and shall cause a certi-
fied copy thereof attested by the Clerk under the seal o
the City of Fresno, to be recorded in the Office of the
County Recorder of the County of Fresno, State of California.
