A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, CALIFORNIA, AUTHORIZING THE PURCHASE
OF COPIER EQUIPMENT WITHOUT ADVERTISING
COMPETITIVE BIDDING.
WHEREAS, the Council has received and considered the report
and recommendation of the Chief Administrative Officer, and upon
such report and recommendation:, the Council finds as follows:
1. The City has rented 23 units of copier equipment from
International. Business Machines Corporation., hereinafter referred to
as "IBM", and the Xerox Corporation, hereinafter referred to as
"XEROX", over a five-year period, which units are identified in the
report of the Chief Administrative Officer.
2, IBM and Xerox have offered to enter into an installment -
purchase agreement with the City .for said equipment with, credit for
accrued rent tip to fifty percent (50%) of the original purchase price,
which offer, if accepted., will result in cost savings to the City.

E 3. Said eq-uipment is patented and if strictly drawn
specifications were put out to "competitive bidding, only IBM and
Xerox could. bid.,
4. Said equipment is unique because credit for accrued rent can
only be applied to the existing leased. machines
5. Accepting the offer of IBM and Xerox would necessarily exclude
all others:, and any attempt at competitve bidding would work: an
incongruity, would not affect the final result, and would produce no
advantage to the City -
IT IS THEREFORE RESOLVED by the Council. of the City of Fresno,
California, that advertised competitive bidding for the purchase of 23
units of copier equipment is dispensed with and the Purchasing Agent
is authorized to execute a contract on behalf of the. City with IBM and
Xerox Corporations for a five (5) year installment -purchase option,
the total cost thereof, including tax, not to exceed: Two Hundred
Thirty Thousand Dollars (�230 , 000 ,) b
