RESOLUTION NO. 79-88
RESOLUTION ' ORDERING VACATION OF ' PUBLIC STREET
WHEREAS, pursuant to Resolution of intention No.. 759-D,
b.
on file herein, a public hearing was held at 7z35 p.m. on the
27th day of February, 1979, at a regular meeting of the
Council of the City of Fresno in the Council Chambers of
the Fresno. City Hall in the City of Fresno, County of Fresno,
State of California, at which time and place evidence was
heard for and against the vacation of the hereinaxter des-
gibed public street situated within the City and County of
Fresno; and
WHEREAS, the City Traffic Engineer has reviewed the
proposed vacation action and determined: that it will have no
adverse effect upon traffic circulation; and
WHEREAS, findings of Environmental Assessment No. 2584
indicate that the proposed vacation action will have "no

possibility of si.gnfican.t effect on the environment"; and
WHEREAS, the Council of the City of Fresno now finds
from all the evidence submitted that such street, hereinafter
particularly described is unnecessary for present and pro-
spective public street purposes;
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FR,ESNO, pur-
suant to the provisions of the "Street Vacation Act of 19411°
being Sections 8300-83" 4 of the Streets and Highways Cede
of the State of California, DOES HEREBY RESOLVE AS FOLLOWS
1. The public interest and convenience require, and
.it is hereby ordered, that as contemplated by Resolution of
Intention No 759--D 'adopted by the Council of the City of
Fresno on the 30th day of January, 1979, the hereinafter
described public street situated in the City and County of

Fresno be and the same are herebyclosed, vacated and aban-
doned for public street purposes.
2 The public street to be vacated is described as
follows. -
BEGINNING at the Southwest corner of Let 12 of
Bonadell,e Homes No. 8, Tract No. 1854 as said Tract is
filed in the office of the County Recorder, Aril 14,
1961 and recorded in Volume . 20 of Plate at Page 62,
Fresno County Records, thence North 00 261`East a
distance of 100 feet to the Northwest corner of said
Lot 12, thence Westerly along the Westerly production
of the North line of said Lot 12, a, distance of 30
feet, thence South:: 00 26' West, parallel with the West
line of said Lot 12, a distance of 100 feet, to the
intersection with the Westerly production of the South
line of'said Lot 12, thence Easterly along the Westerly
production of the South line of said Lot 12, a distance
of 30 feet to the POINT OF BEGINNING.
The City of Fresno does hereby reserve and except from
the vacation the permanent easement and right at any time, or
from time to time, to construct, maintain, operate, replace,
remove and renew sanitary sewers and storm drains annd appur-
tenant structures and pursuant to any existing franchises
or renewals thereof, of otherwise to construct, maintain,
operate, replace, remove, renew and enlarge linos of pipe,
conduits, cables, wires, poles, and other convenient
structures, equipment and fixtures for the operation of gars
pipe Lines, telegraphic and telephone lines, railroad Tines,
and for the transportation or distribution of electric energyy,
petroleum and its products, ammonia, water, and incidental
purposes, including access and the right to keep the property
free from inflammable materials, and good growth,, and other-
wise protect the same .from all hazards in, upon, over and
across the entire area herein vacated:
4. That all proceedings for the vacation of such street
and alley shall be and they are taken subject to the fore-
going reservat,on.s and exceptions.
5 The Council finds and determines that the rights of way
or parts thereof vacated are not useful as bicycle paths or
routes.

6. The City Clerk of the City of Fresno shall certify
to the passage of this resolution and shall cause a certified
copy thereof attested by the Clerk under the seal of the City
of Fresno, to be recorded in the Office of the County Recorder
of the County of Fresno, State of Californian
CLERK'S CERTIFICATION
I hereby certify that the foregoing Resolution No. 79-88 _
was regularly passed and adopted by the Council of the City of
Fresno at a meeting held on the _211h_ day of Februm 1979
