RESOLUTION NO 79081
A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO r CALIFORNIA, PRELIMINARILY DETERMINING
THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE .
THE IMPROVEMENTS- ®R ACQUISITIONS HEREIN GENERALLY
DESCRIBED; SETTING TIME AND PLACE OF HEARING
FOR DETERMINING PUBLIC CONVENIENCE AND NECESSITY
FOR THE CONSTRUCTION OR ACQUISITION OF SUCH
IMPROVEMENTS WITHOUT PROCEEDING UNDER THE
"SPECIAL ASSESSMENT INVESTIGATION, LIMITATION
AND MAJORITY PROTEST ACT OF 1931"1 AND DIRECTING
NOTICE IN THE MATTER: OF CITY OF FRESNO ASSESSMENT
DISTRICT NO. 79
WHEREAS, by its Resolution No. 79_79 this Council has
approved a map of a proposed _special assessment district designated
"CITY OF FRESNO ASSESSMENT DISTRICT NO. 79"1 the exterior
boundaries of which proposed distr act are as shown on such map; and
WHEREAS, such map is on file with the City Clerk as part
of said Resolution No. 79- 79 and
WHEREAS o the area within the proposed district includes
those properties generally bounded by Tulare Avenue on the north,
f
by Chestnut Avenue and Garden Avenue on the east, by Butler Avenue
on the south, and by Maple Avenue on the west; and
WHEREASf it appears that the public convenience and
necessity require that improvements or acquisitions within such
area be made as hereinafter described and that the costs and
expenses thereof be made chargeable upon an assessment district
bounded as above described; and
WHEREASr it appears that such assessment proceedings
should be taken without complying with the provisions of the
"Special Assessment Investigation, Limitation and Majority Protest
Act of 1931"
NOWT THEREFORE t THE COUNCIL; OF THE CITY OF FRESNO DOES
HEREBY RESOLVE, FIND!, DETERMINE AND ORDER AS FOLLOWS t

1. The Council preliminarily determines that thepublic
convenience and necessity require -that the improvements or
acquisitions hereinafter described shall be made, and the cost and
expense thereof be paid for by special assessments levied upon the
property within the district benefited thereby and by contributions
from the City of Fresno or any other authorized source, and that all
necessary proceedings therefor should be taken without complying
with the provisions of the "special Assessment Investigation,
Limitation and Majority Protest Act of 1931".
2. The boundaries of the proposed assessment district
are shown on the map of "Proposed Boundaries City of Fresno
Assessment District No. 79", approved by Resolution No. 79-79
of this Council and on file with the City Clerk of the City of
Fresno, and include those properties generally bounded by Tulare
Avenue on the north, by Chestnut Avenue and Garden Avenue on the
east, by Butler Avenue on the south, and by Maple Avenue on the
west,
3. The improvements to be constructed or acquired are
generally described as follows.
Excavation and grading; removal of street improvements:
where required; construction and installation of concrete curbs,
gutters, steps, driveway approaches, sidewalks and retaining walls
where required; removal or relocation of sprinkler systems where
required; construction of valley gutters, curb returns, alley
approaches, asphalt concrete pavement overlay and reconstruction of
streets where required; construction of storm drainage facilities,
including storm drain pipelines, cross -drain siphons, drain inlets,
laterals, manholes, and appurtenances; the doing of all transition
work and the construction and acquisition of all improvements and
rights -of -way auxiliary to any of the foregoing and necessary to
carry out same in accordance with the requirements of the City of
Fresno

4. NOTICE IS HEREBY GIVEN that Tuesday, the 20 day of
_ March , 1979, at the hour of 2:15 P.M. in the regular meeting
place of this Council, Council Chamber, City Hall, 2326 Fresno
Street, Fresno, California, is fixed as the time and.place when and
where any and all persons interested may appear and show cause, if
any they have, why the Council should not finally find and
determine that the public convenience and necessity require the

proposed improvements and acquisitions without compliance with the
"Special Assessment Investigation, Limitation and Majority Protest
Act of 1931". Any person interested may at such time and place
object to the undertaking of such proceedings without first
f complying with the provisions of the Investigation Act.
5. The City Clerk is directed to publish a copy of this
Resolution twice in the Fresno Bee a
newspaper of
general circulation published and circulated in the
City of Fresno, the first publication to be completed at least ten
(10) days before the day of the hearing, as hereinabove set forth.
