RESOLUTION NO 79--` 80
A RESOLUTION OF THE COUNCIL OF THE CITY
OF FRESNO, CALIFORNIA, APPOINTI14G ENGINEER
AND ATTORNEY FOR CITY OF FRESNO ASSESSMENT
DISTRICT NO, 7
WHEREAS, this Council has commenced proceedings pursuant
to appropriate special assessment and assessment bond acts for the
construction and financing of public improvements in the City of
Fresno; and
WHEREAS, the public interest and general welfare will be
served by appointing and employing an engineer and an attorney for
the preparation and conduct of such proceedings and work in
connection with such improvements.
NOW, THEREFORE, THE COUNCIL ` OF THE CITY OF FRESNO DOES
HEREBY RESOLVE AS FOLLOWS
1. James L. Martin, Public Works Director of the City
of Fresno, California, is hereby appointed as Engineer of Work to
do and perform all services inmaking preliminary surveys,
preparing plans, estimate of costs and diagram and assessment, and
his compensation is hereby fixed at the sum of ten and one --half
percent (10--1/2%) of the total assessment.
2. James A. McKelvey, City Attorney for the City of
Fresno, California, is hereby appointed and employed to do and
perform all legal services required in the conduct of such
proceedings, including any court proceedings for the determination
of damages for the works and improvements, and his compensation is
hereby fixed at two percent (2%) of the total assessment.
3. The compensation of the Engineer of Work, the costs
and expenses of construction engineering and inspection, and the
attorney's fees shall be included as incidental expenses of the
proceedings, and shall be assessed as directed in the Resolution
of Intention to be adopted in the proceedings.

hereby certify that the foregoing resolution was regularly
introduced and adopted by the City Council of the City of Fresno at
a regular meeting held on the 27th day of February j 1979, at
the City Hall in the City of Fresno, by the fallowing vote:
