RESOLUTION No. 79-78
RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA,, AUTHORIZING EXECUTION OF THE CONSENT
TO COW ON USE AGREEMENT BY AND BETWEEN THE PACIFIC
GAS AND ELECTRIC COMPANY AND THE CITY OF FRESNO.
WHEREAS, as a condition of approval and in accordance with the
Woodward Park Community Plan, adopted in 1976, the Subdivider of
Tract No. 3 014 -- "Woodward Manor Estates" was required.to dedicate
to the City of Fresno a 24-foot wade bicycle path and landscape
easement within. an existing Pacific Gas and Electric Company

f Transmission Line Easement across the southern limit of the Sub-
division; division; and,
WHEREAS, on December 5, 1978, Woodward Manor Estates, a
limited partnership, the Subdivider of Tract No. 3014 offered for
approval the Final Map of Tract No. 3014 which included the offer
of dedication for a 24-foot wide bicycle path and landscape ease-
ment, and: requested the appropriate Subdivision Agreement; and,
WHEREAS, on December 5,, 1978 the Council of the City of Fresno
adapted Resolution No. 78-�533 approving the Final, Subdivision "Map
of Tract No. 3014 "Woodward Manor Estates", and accepting dedica-
ted public uses therein, and approving and authorizing execution -of
the Subdivision Agreement; and
WHEREAS, the Subdivider of Tract No. 3014 entered into an
Agreement with the City of Fresno dated December 61 1978 to provide
for the construction of the required off -site improvements to
include the required improvements within the 24-foot wide bike
path and landscape easement; and,
WHEREAS, the Pacific Gas and Electric Company has requested
the City of Fresno to enter into a Consent to Common Use Agreement
to provide for the bicycle path and landscape easement located
within the existing Pacific Gas and Electric Company Transmission
Line :basement; and,
WHEREAS, the Pacific Gas and Electric Company has provided
the City of Fresno with the Consent to Common Use Agreement and
has requested the City of Fresno to execute said. Agreement; and,

WHEREAS, the City Attorney's Office has reviewed and approved
said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Fresno as follows
1. That the Public Works Director of the City is hereby
authorized to execute on behalf of the City the Consent to
Common Use Agreement by and between the Pacific Gas and
Electric Company and the City of Fresno.
