A RESOLUTION OF THE COUNCIL OF THE CITY
OF FRESNO, CALIFORNIAt AUTHORIZING
CONSTRUCTION OF A WATER DIVERSION
STRUCTURE AT WOODWARD PARK WITHOUT
ADVERTISED COMPETIT-11VE BIDDING AND
DECLARING THE URGENCY THEREFOR.
WHEREAS, the Council has received and considered the
report and recommendation of the Chief Administrative Officer,
and upon such report and recommendation, the Council finds as
follows:
1 The Fresno Irrigation. District (FID) has given the
City of Fresno permission to construct a water diversion
structure at Woodward: Park to divert irrigation water from
the Forkner 30" pipe line to the Woodward Park lakes provided
a
that said work must commence on March 1, 1979 and rust be

completed by March 21a 1979, due to FID's water delivery l
schedule.
2. Said work will. facilitate the delivery of surface
water needed this season at Woodward Park in lieu of water 1
pumped from the underground water supply,, which surface water
will be drawn from the City's water allotment under its
contract with FID.
3. The City obtained informal bids to speed up the
procurement process in reliance upon. the engineer's estimate
that said work would cost between $5,650 and $5,350 and,
therefore, would not be subject to competitive bidding require-
ments. The lowest informal base bid was received. from EL
CAMINO CONSTRUCTION COMPANY to do said work at a cost of
$8, 950.99.
4 Time is of the essence in commencing and completing
said work. Any attempt at competitive bidding would work
an incongruity, would not affect the final result and `would
produce no advantage to the City.

NOW, THEREFORE, IT IS RESOLVED by the Council of the
City of Fresno, as follows:
1. The Council awards the contract for construction of
a water diversion structure at Woodward Park to divert irrigation
water from the.Fo,rkner 30" pipe line to the Woodward Park
lakes to EL CAMINO CONSTRUCTION COMPANY according to its
base bid without advertising: for bids as otherwise required by
Charter Section 1208 and Fresno Municipal Code Section 3-105,
the total contract price to be $8,950.991 and authorizes the
Public Works Director to execute same.
2. The Council deems such work to be of urgent necessity
for the preservation of life, health and property in that said
work is urgently required to gain the use of one season's
irrigation water for Woodward Park at no extra cost, save one
season's cost of electrical energy by minimizing the pumpage of
water from the underground water supply, conserve energy
and conserve the underground water supply.
