HomeMy WebLinkAboutResolution - City Council - 79-065 - 1979-02-20Ruth Pool ter s Ed Biellckl REsowuoN No. 7 9 - 6 5 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESIN`O MAKING APPLICATION FOR APPROVAL OF PROPOSAL TO INITIATE THE ANNEXATION OF TERRITORY DESIGNATED THE ALLUVIALg--BLA.CKSTONE NO. 2 ANNEXATION WHEREAS, pursuant to the Municipal' Organization Act of 1977, beginning with Section 35000 of the Government Cade, the Council desires to annex the hereinafter described territory to 'the City of Fresno in order to promote the logical formation and determination of City boundaries and to encourage orderly growth and development which are essential to the social, fiscal, and economic well-being of the City; and WHEREAS, the territory herein proposed to be annexed is designated the Alluvial - Blackstone No. 2 Annexation and consists of that real property situated in the County of Fresno, State of California, the boundaries of which are specifically described in Exhibit A attached hereto and incorporated herein by this reference and more particularly depicted upon a map marked Exhibit "B" attached hereto and incorporated f herein by this reference; and WHEREAS, pursuant to the requirementssetforth in Government Code Section 35102, a service plan for the subject territory has been prepared and said service plan is attached hereto as Exhibit "C" and, by this reference, made part of this resolu- tion; and 'WHEREAS, review and analysis of the envirormental,assessment related to said annexation project is in progress with the Evaluation Section of the Department of Planning and Inspection of the City of Fresno; and WHEREAS, an informational: letter explaining the ramifications' of annexation will be mailed to all property owners witlain the subject territory at the time of filing with the Fresno Local Agency Formation Commission; and - WHEREAS, the Council, finds that the territory contained in the proposalz a. Does not exceed 100 acres in area and such territory constitutes the entire unincorporated island of territory; b. Is surrounded by the City of Fresno which is proposir_g the annexation; C. Is subs�:antially developed, or developing; d. Is not prime agricultural land Las defined in Section 35046; and e. Will benefit from such annexation and is receiving certain benefits from the City of Fresno. WHEREAS, the Fresno County Assessor's roll will be used for the purpose of levying any assessments or taxes on the subject territory. N" This correspondence is in response to your recent request for comments associated with the subject annexation proposal. A major portion of the drainline system serving the subject area, currently exists Included within this system is a 241 pipeline along the Fria.nt Road alignment. This line is more commonly refered to as the Bos Ditch, which has the dual functions of transmitting bath: urban storm water as well as irrigation water. In addition a_30 inch pipeline located approximately midway between West Birch and West Spruce Avenue has also been constructed. This line shall, transfer the storm Water from the subject area to the 20 acre basin facility located between Fresno and: First . Streets on the Forth side of Herndon Avenue., A major portion of the basin site" serving the proposed area has been excavated and is suitable for receipt of urban storm water. Once the _pipeline along the West Birch and West Spruce Avenue alignments ,is continued to the basin facility, the subject area shallreceive master planned drainage service. In addition to urban storm 'drainage, the soil strata of the basin site indicates excellent recharge capabilities for introduction of surface water to the underground reservoir. Blackstone No 2 Annexation This is in response to your memorandum of January 12, 1979 relative to the Service Plan for the proposed Alluvial - Blackstone No. 2 Annexation With respect to the content and accuracy of the information originally submitted by the author of the Service Plan, the individuals cited as department sources for the information: were given incorrectly, in addition the information attributed to the sources was misstated. This 1-5 net an acceptable situation: and must be corrected in future applications However, to respond to this application in a timely manner, staff has reviewed the plan and submits the following as the official. Department response to the various service provided by Public Works. 1 Community Waters The proposed Annexation is lo- cated within the Pinedale County dater District's area of influence. 2,. Sewage collection The proposed: Annexation is located within- the Pinedal.e County Water District's area, of influence. 3 Solid Waste Collection: Solid waste services will be provided in accordance with Article 4. Chapter 9 , of the Fresno municipal. Cade. 4. Street Lighting, The Pinedal.e Highway Lighting District (P.H.L.D ) presently serves the subject territory with street lighting. Reorganization will detach the -territory from P . H. LL, B. and trans- fer operating and imaintenance costs to the City of Fresno. The Ci "t,y has a policy of providing mid -black street lighting. Street Swe�gp Street sweeping can be performed only on streets having concrete curbs If the surface ` is permanently paved, it will. be scheduled for regular sweeping as frequently as once per :month in residential areas and as 'fre-- quently as three times per week in commercial' areas (or in accordance With existing agreements If the surface is oil -dirt, it will be scheduled for sweeping as frequently as once per year. Unusual sweeping needs will be dealt with ran basis of the relative individua31; merits of the needs. Sweeping frequencies suggested herein are valid as of the date of this correspondence and do not consider fixture effects of Proposition. 13 or other economic realities. For this reasont questions of specific service,levels at specific ' locations at times other than this date should be referred to the Public Works Department for response. 6. Street Improvements: The City has no Capital, Im- provement projects scheduled -for the area to be - annexed, The installation ref street improvements i.e.; concrete curbs, gutters, sidewalks, drive -- way approaches and permanent street pavement will occur as development of the various properties takes place as a condition of development.
