RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO
APPLYING TO THE FRESNO LOCAL AGENCY FORMATION
COMMISSION IN THE MATTER OF THE PROPOSED OLIVE--
JACKSON NO. 3 DISTRICT REORGANIZATION, INCLUDING
THE DETACHMENT OF CERTAIN TERRITORY CONSISTING`
OF 5.50 ACRES FROM THE MID VALLEY FIRE PROTECTION
DISTRICT AND THE ANNEXATION OF SAID TERRITORY TO
THE CITY OF FRESNO
WHEREAS, this proposal is made pursuant to the District Reorganization Act
of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of
the California Government Code; and
WHEREAS, the nature of the proposed change is a reorganization: consisting
of the detachment of certain territory consisting of 5.50 acres hereinafter
nailed the "subject territory„ from the Mid Valley Fire Protection District and
the annexation of the subject territory to the City of Fresno, and
WHEREAS, no other counties, cities, or districts are affected; and
WHEREAS,, the subject territory proposed to be detached from the Mid Valley
Fire Protection District and annexed to the City of Fresno is uninhabited and
is described in Exh,-bi,e "A" and graphically depicted upon the map marled Exhibit
"B" and, by these references, made part of this resolution and
WHEREAS, review and analysis of Environmental Assessment No. 2315 related
to said district reorganization project has resulted in a Negative Declaration
by the Director of Planning and Inspection; and
WHEREAS, pursuant to the requirements set forth in Government Code Section
35102, a service plan for the subject territory has been prepared and said service
plan is attached hereto as Exhibit "G" and, by this reference, made part of this
resolution; and
WHEREAS, no new district-s are proposed to be formed by this reorganization;
and
WHEREAS, the, Fresno County Assessor's roll will be used for the purpose of
levying any assessments or taxes on the subject territory; and
WHEREAS, the exemption of all the subject territory proposed to be annexed to
the City of Fresno from taxation for the payment of principal or interest, or any
other amounts which shall, become due on account of any outstanding bonded indebted-
ness incurred by the City prior to the effective date of such annexation; and
WHEREAS, upon completion of this reorganization proposal, the subject terri-
tory will be included: in Municipal Bond Area "D" and will not be taxed for any

existing bonded indebtedness or contractual obligations; and

WHEREAS, the reasons for this proposed reorganization are stated as
follows
1. Annexation of the subject territory to the City of Fresno will
result in improved land use planning. All private development
controls of.. the City will apply- following reorganization.
2. The subject territory is within the City of Fresno,°s Sphere of
'Influence,
3 The consolidation of the subject area into one detachment annex-
ation project is beneficial to the affected governmental prooesses
and the resultant City and district boundaries.
NOW, THEREFORE, BE IT RESOLVED that the Council of, the City of Fresno hereby
requests that proceedings be taken by the Fresno Leoal. Agency Formation Commission
for the herein. proposed Olive -Jackson No. 3 District Reorganization, including the
detachment of the subject territory, consisting of 5.50 acres from the M d Valley
Fire Protection District and the annexation of the same territory to the City of
Fresno,

TO THE CITY OF FRESNO
Consists of Lots 34 and 35 and a portion of Lot 36 of Bernhard Gardens, Lots
1--3, Blk. 56, of Sierra Vista Addition No 5 and a portion ,of Section 36 13/20,
M.D.M.
BEGINNING at the Southwest corner of the East Half of the Southeast Quarter of
the Northwest Quarter of Section 36, Township 13 South, Range 20 East, Mount Diablo
Meridian, as said Section is shown on the United States Township Plats, being also,
a point on the existing City Limits of the City of Fresno, thence Northerly along
the West line of the East Half of the Southeast Quarter of the Northwest Quarter
of said Section 36, being also, along the existing City Limits, to the intersection
with a line which. is 30.00 feet North of, and parallel with, the North line of Lot
34 of Bernhard Gardens, according to the map thereof, filed in the Office of the

Gardens, thence Southerly along the Northerly production of the West line of t1he

OLIVE.-JACKSON NO. 3 DISTRICT REORGANIZATION
SERVICE PLAN
July.21, 197$
This service planis prepared in accordance 'with the requirements of Government
Code Section 35102. .Each major service subject is discussed based on existing
conditions and adopted City plans and policies. The purpose of this document: is
to *provide information regarding the availability of City municipal services . and
how they will be p1 ov :d.ed to the subject territory should annexation to the city
occur, ,Any required modification, expansion or extension to existing faci_liites
in order to serve the subject territory will be discussed based on.applicable
City ordinances. Where appropriate, the financing and placement of such services
and facilities will be discussed.
Summary
E The proposed Olive --Jackson No. 3 District Reorganization : consists -of the annexa-
tion of 5.50 acres to the City of Fresno and the detachment of the same 5.50 acres
C from the Mid Valley Fire Protection District. The subject territory is generally
located on the west side of North Jackson avenue between East Clay and East Hammond
Avenues. The land use consists of six single family dwellings; two apartment build_
.ngs.; three business establishments and vacant land. The zoning within the project
area consists of R 1, R--3 and M 1 zone classifications.
Sewer Service
There are two suer mains 'Located in the vicinity of the subject territory. There
is an eight --inch sewer main located in North Jackson Avenue and a ten -inch sewer
main located in East OliveAvenue which narrows to eighty -inch east of North Jackson
Avenue. All but five parcels within the subject territory are connected to the
Cityfs sanitary sewer system. Two of the five parcels not connected.to City
sewers are vacant. Sanitary sewer service is available to the entire project area
from the eight --inch and ten -inch mains previously described.
Water Service
The subject territory is receiving water service from the City of Fresno. All
but the two vacant parcels within the project area are presently receiving City:
water service.
Fire Hydrants
There are no fire hydrants Located within the subject territory. However, there
is one fire hydrant at the northwest corner of 14orth Jackson and East Hammond
Avenues across the street from the project area and another fire hydrant is
located at the southeast corner of North Jackson and East Hedges Avenue. These
existing hydrants can partially serve the project area.

East Hammond Avenue; three 75--watt, high pressure sodium, street lights in
North Jackson Avenue and two 250-watt, high pressure sodium, street lights
along East Olive Avenue. The City will assume installation expenses and all
energy axed maintenance; costs for street lights installed as a result of this
annexation. Presently;, there are no street lights within the subject territory.
The effect of Proposition 13 on the provision of these services is unknown at
this time.
Traffic Engineering/Street Improvements
East Olive Avenue is designated as a four lane collector,, East Clay and: East
Hammond Avenues are designated local streets., East Olive is a partially_
improved four lane street with permanent paving, curbs and gutters. Installation
of permanent sidewalk would bring East Olive Avenue ;up to its designated standards
East Clay and East Hammond are partially improved and additional street improve-
ments such as permanent paving, curbs and gutters, sidewalk will be required in
order to bring these streets up to their designated standards.
Transit Services
.Fresno Transit Route No. 35 presently serves the subject territory. This Olive
Avenue Cross --town. Route provides service at 30 minute intervals between Marks
and Clovis Avenues, Handy Ride services will continue to be provided to qual,
fied residents and will not be affected by the annexation.
Solid Waste Disposal
The residents/property owners within the subject area, are receiving private
solid waste disposal services.
Upon annexation, City waste disposal services will become available to the resi-
dents/property owners within the subject area.
State law provides that private solid waste disposal services may continue ,for
a period of up to five years from the elate an area ia annexed to the City pro-
viding these services meet conditions l through.'3 below. Otherwise, services
must be obtained from the City's Waste Disposal. Division. la any event, con-
version to City Waste Disposal. Services must occur within five years of the
date of annexation.
I.. The company must have been licensed by the County of Fresno for a minimum
of three years. This includes: Cannon Disposal Service, Browning -Ferris
Industries of California, Inc.. Industrial Waste and Salvage Co.; (IWS)r
Fresno Disposal; Fresno -Roll Off Service; and Thrifty Best Rubbish Service.
2 A customer cannot change from one disposal company to another, only to the
City's Waste Disposal Service,
