.RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO
ORDERING VACATION AND ABANDONMENT OF A. PORTION
OF A STREET SUPERSEDED BY RELOCATION
WHEREAS, this Council is authorized, by Chapter 5 of Division
2.5 of the Streets and Highways Code of the State of California
being Section 1930-1934 of such code, to vacate and abandon any
portion of a street which portion has been superseded by relocation,
and
WHEREAS, it is hereby .found by the Council that the following
described portions of streets to be vacated ;and _abandoned have been
superseded by relo:ation.
NOW, THEREFORE, THE COUNCIL Off' THE CITY OF FRESNO, pursuant to
the Streets and Highways Code, DOES HEREBY RESOLVE:
1. That the hereinafter described portions of public streets
in the City and County, of Fresno be and the same are hereby closed,
vacated and abandoned for public street purposes. ,
2. That the description of such portion of public streets to
be vacated and abandoned is as follows:
Portions of N. Mi_ll.,brook .Avenue lying in Lots 34 35
and 36, inclusive, of Headliner Homes No. 27 as said
Lots are shown on the Map of Headliner Homes No. 27,
filed in the Office of the: County Recorder December
26, 1973 and recorded in Volume 28 of Plats at Rage
46, Fresno Counter Records, and as shown on the attached
Exhibit "A"
3 That the City of Fresno intends to reserve and except from
the proposed vacation the permanent easement and right at any time,
or from time to time, to construct, maintain, operate, replace, remove,
and renew sanitary sewers and storm drains and appurtenant. structures
and pursuant to any existing franchises or renewals thereof, or
otherwise, to construct, maintain, operate, replacer remove, renew
and enlarge lines of pipe, conduits, cables, wires, poles, and other
convenient structures, equipment and fixtures for the operation of
gas pipe lines, telegraphic and telephone lines, railroad lines, and

for the transportation or distribution of electric energy, petroleum
and its products, ammonia, water and incidental purposes, including
access and the right to keep the propertyfree from flammable materials,
and wood growth, and otherwise protect the same from all hazards in,
upon, over and across that 10 foot wade publicutility easement as
dedicated adjacent to North Millbroak Avenue relocated and bring
within Lots 34--36 inclusive as shown on the map of Headliner domes
No. 27, Tract No. 2450 recorded Decem;ber'26, 1973 in Volume 28 of
Plats at Page 46, Fresno County Records.
4. That all proceedings for the vacation of such street are
intended to be and shall be taken subject to the foregoing reserva¢-

6. The City Clerk of the City of Fresno shall certify to
the passage of this resolution and shall cause a certified cope

of Fresno, State of California.
