RESOLUTION NO 79-4 5
RESOLUTION OF INTENTION TO VACATE PUBLIC STREETS, ALLEYS
.AND PUBLIC UTILITY EASEMENT UPON PERFORMANCE OF CONDITIONS
WHEREAS, pursuant to Resolution of Intention. No. 761-D adopted.
on January 16, 1979, the Council of the City of _ Fresno declared its
intention to order the vacation of a portion of Mono Street between.
the R-S Alley and State Freeway 41 Inyo Street between R Street
and Huntington Boulevard; S Street between Mono and Inyo Streets;
RrS Alley between Inyo and Mono Streets; S - State Freeway41.
Alley between Inyo Street and State Freeway 41.;" and the Public'
Utility Easement in the previously vacated S Street between Inyo r
Street and Huntington. Boulevard.
For further particulars as to the proposed vacation,

reference is hereby made to the map entitled "Map Attached to
Resolution of Intention 761_D on file in the Office of the City
Clerk of the City of .Fresno, at the Fresno City Hall., 2326 Fresno
Street, Fresno, California, 93721,<
WHEREAS, this Council fixed the hour of 2:40 p.m„ of the
6th day of February, 1979, in the Council. Chambers of the Fresno
City Hall, 2326 Fresno Street, Fresno, California, as the time
and place for herring upon such resolution, ,and
' WHEREAS, the City Traffic Engineer has reviewed the Proposed

vacation action and has determined that it will hav-;)-, no adverse
effects upon traffic circulation; and
WHEREAS,, the proposed vacation action will have no signif i-
cant effect upon the environment as indicated by Environmental
Assessment No. 1291 and
WHEREAS, the proposed vacation action will. have no significant
effect upon the environment as indicated by Environmental Assessment
No. 12 91 and
WHEREAS,, the Council of the City of Fresno therefore finds and
determines from all the evidence submitted as follows:
1. Due notice of such hearing was given as required by law.
2. Said streets and alley are unnecessary for present and
prospective 8t.reet purposes,. provided the following work is
done prior to the vacation thereof,

A. Removal of all existing street improvements
within the streets and alleys proposed to be
vacated.
B. Construct all street improvements necessary
to close the proposed vacated streets and alloys
to through traffic
C. Construct a special cul-de-sac at Mono Street
and the R-S Alley designed to maintain traffic
circulation.
D. Construction of underground, fa.oilitles in Under-
ground Utility District 23.
E. Dedication of a 20.foot wide Sanitary Sewer Ease -
meet between R and S Streets, 123.79 feet North
of Mono Street.
NOW, THEREFORE;, the Council of the City of Fresno, pursuant
to the provisions of -the "Street Vacation Act of 1941", being
Sections 8300-8374 of the California Streets and. Highways Code,
DOES HEREBY RESOLVE AS FOLLOWS
1. That the hearing having been closed, the matter shall
be and it is hereby continued to such time as the Public Works
Director shall have determined that the aforementioned work has
been completed and presents the matter again to Council., and at
such time it shall be -the intention of this Council to adopt an
appropriate resolution ordering the vacation of Mono Street be-
tween the R-S Alley and Freeway 41, Inyo Street between R Street
and Huntington. Boulevard, S Street 'between Mono and Inyo Streets,
the R--S Alley between Inyo and Mono Streets, the S-�T Alley be- j
tween Inyo and Freeway 41 and the; public utility easement in the
previously vacated S Street between Inyo Street and Huntington
Boulevard hereinbefore described provided that evidence is
submitted to the satisfaction of the Council that the :hereinW-
before --described work has been completed and
2 That any and all Reservations and: Exceptions to this
vacation as contained in Resolution of Intention No. 761-D are
and they shall apply to this resolution.

3. That this Council's preliminary determination made in
Resolution of Intention No. 740-D is herein reiterated that the
rights--of--way or pa4rts thereof proposed to be vacated are not
useful as bicycle paths or routes

I hereby certify that the foregoing resolution was duly and
regularly passed and adopted by the Council of the City of Fresno
at a regularimeeting of said Council in. the City of Fresno
County of Fresno, State of California, the 6 th day of
