RESOLUTION No, 79 — 3 9 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO APPLYING TO THE FRESNO LOCAL AGENCY FORMATION COMMISSION IN THE MATTER OF THE PROPOSED TULARE- PEACH NO. 1-A DISTRICT REORGANIZATION, INCLUDING THE DETACHMENT OF CERTAIN TERRITORY CONSISTING OF 13+ ACRES FROM THE MID VALLEY FIRE PROTECTION DIS- TRICT AND THE ANNEXATION OF SAID TERRITORY TO THE CITY OF FRESNO WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Government Code; and WHEREAS, the nature of the proposed change is a reorganization consisting of the detachment of certain territory consisting of 13+ acres hereinafter called the "subject territory" from the Mid Valley Fire Protection District and the annexa- tion of the subject territory to the City of Fresno; and WHEREAS, no other counties, cities, or districts are affected; and WHEREAS, the subject territory proposed to be detached from the Mid Valley Fire Protection District and annexed to the City of Fresno is uninhabited and is described in Exhibit "A" and graphically depicted upon the map marked Exhibit "B" and, by these references, made part of this resolution; and WHEREAS, review and analysis of Environmental Assessment No. 2522 related to said district reorganization project has resulted in a Negative Declaration by the Director of Planning and Inspection; and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the subject territory has been prepared and said service plan is attached hereto as Exhibit "C" and, by this reference, made part of this resolution; and and WHEREAS, no new districts are proposed to be formed by this reorganization; WHEREAS,the Fresno County Assessor's roll will be used for the purpose of levying any assessments or taxes on the subject territory; and WHEREAS,, the exemption of all the subject territory proposed to be annexed to the City of Fresno from taxation for the payment of principal or interest, or any other amounts which shall become due on account of any outstanding bonded indebted- ness incurred by the City prior to the effective date of such annexation; and WHEREAS, upon completion of this reoganizatiQn proposal, the subject territory will be included in Municipal Bond Area "D" and will not be taxed for any existing 11Z Page I of 2 Pages "All Em bonded indebtedness or contractual obligations; and WHEREAS, the reasons for this proposed reorganization are stated as follows: 1. Annexation of the subject territory to the City of Fresno will result in improved land use planning. All private development controls of the City will apply, following reorganization. 2. The subject territory is within the City of Fresno's Sphere of Influence. 3. The consolidation of the subject area into one detachment -annexation project is beneficial to the affected governmental processes and the resultant City and district boundaries. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno hereby requests that proceedings be taken by the Fresno Local Agency Formation Commission for the herein proposed Tulare -Peach No. 1-A District Reorganization, including the detachment of the subject territory, consisting of 13+ acres from the Mid valley Fire Protection District and the annexation of the same territory to the City of Fresno. 11 STATE OF CALIFORNIA COUNTY OF FRESNO ss CITY OF FRESNO CLERK'S CERTIFICATION 1, JACQUELINE L. Each major service subject is discussed based on existing conditions and adopted City plans and policies. The purpose of this document is to provide information regarding the availability of City services and how they will be provided to the subject territory should annexation to the City occur. Project Summary The proposed district reorganization consists of eleven parcels containing 13+ acres and is generally located on the southeast corner of the intersection of North Peach and East McKenzie Avenues. The proposed district reorganization involves the detachment of the entire 13+ acres from the Mid Valley Fire Protec- tion District and the annexation of the same territory to the City of Fresno. The subject property is zoned R-A. There are eight single family dwellings located within the project area. Sewer At the present time sewer service is being provided to the residences within the project area by private septic systems. Future service could be provided to the subject territory from an existing 10" City sewer main located in East Tulare Avenue. However, due to the in -process development of 19.88 acres directly across North Peach Avenue adjacent to the project area, the city is proposing to install an 8" sewer main in North Peach Avenue north of East Tulare Avenue. This 81' sewer main could be used to provide sewer services to the subject area upon annexation at the cost of the developer. Water The subject territory is located within the service area of the Batman Water Company and will continue to receive water services from the company after the subject territory is annexed to the City. Fire Hydrants There are no fire hydrants located within the project area, however, there are fire hydrants located within the general vicinity of the proposal area, as shown on the attached land use map. Upon development all fire hydrants required as a condition for proposed development will be installed to the City of Fresno stand- ards at the expense of the developer. EXHIBIT "C" Fire Protection The subject territory is presently receiving fire protection service from Mid Valley Fire Station No. 8 located approximately 1/2 mile southeast of the project area near the intersection of East Tulare and North Minnewawa Avenues. Upon annexation the area will receive City fire protection services from Fire Stations No. 8 and 10 located 3 1/2 miles southwest and 2 miles north of the project area, respectively. Paramedic Service Paramedic services are being provided to the area from Mid Valley Fire Station No. S. Upon annexation paramedic services will continue to be provided by Mid Valley Fire Station No. 8 based on an agreement between the Mid Valley Fire Pro- tection District and the City of Fresno. Police Protection The subject territory is presently receiving police protection from the Fresno County Sheriff's Department and the California Highway Patrol. Upon annexation City police protection will be provided as an extension of services now being provided to the surrounding incorporated areas. Street Sweeping Street sweeping will be provided to the area upon annexation conditioned upon the installation of permanent paving, concrete curbs and gutters. Due to the passage of Proposition 13, the frequency of street sweeping services is uncertain. Transit Services Fresno Transit Routes Nos. 31 and 42 are the closest routes to the project area. Route 31 travels east and west on Tulare Street, and Route 42 travels north and south on Peach Avenue. Service is provided on the basis of 30-minute intervals with 15-minute intervals during peak hours. The Handy Ride program now serving eligible residents of the area will continue following annexation. Street Lighting/Traffic Signalization. Upon annexation the City will install five 70-watt high pressure sodium streetlights on North Peach Avenue adjacent to the project area. The City will assume installa- tion expenses and all energy and maintenance costs for streetlights installed as a result of annexation. There are no streetlights presently within the project area. No traffic signals are anticipated at this time. Traffic Engineering/Street Improvements North Peach Avenue adjacent to the project area is designated as an arterial, however, it is partially improved and will require additional improvements such as curbs, gutters, sidewalks, permanent paving, and additional road rights -of - way in order to bring it up to its designated standard. Parks and Recreation Upon annexation the parks and recreational needs of the purposed area will not be adequately met as defined by the Parks and Recreation Department. The Department's standard requires the location of a neighborhood park, within one mile of each residence to serve the recreational needs of the youth, seniors, and adults in the area. The nearest facility to meet that need is approximately one and one-half miles southwest of the project area at the Mosqueda Center. Animal Control There will be no difference in the level of animal control services provided by the Society for the Prevention of Cruelty to Animals throughout the Fresno Metro- politan Area upon annexation. Utility Tax The City's 4.6 percent utility tax would be applicable to all natural gas, electricity, and telephone bills. The actual cost of such tax could be estimated by relating this tax rate to current utility bills. Property Tax Due to the passage of Proposition 13, no difference in the tax rate is anticipated. Solid Waste Disposal The residents/property owners within the subject area are receiving private solid waste disposal services. Upon annexation City waste disposal services will become available to the residents/property owners within the subject area.' State law provides that private solid waste disposal services may continue for a period of up to five years from the date an area is annexed to the City pro- viding these services meet conditions 1 through 3 below. Otherwise, services must be obtained from the City's Waste Disposal Division. In any event, conver- sion to City Waste Disposal Services must occur within five years of the date of annexation. 1. The company must have been licensed by the County'of Fresno for a minimum of three years. This includes: Cannon Disposal service, Browning -Perris Industries of California, Fresno Roll -off Service, and Thrifty Best Rubbish Service. 2. A customer cannot change from one disposal company to another only to the City's Waste Disposal Service. 3. The quality and frequency of services of the private compan- y must meet the standards required by the City of Fresno. An information sheet on the "City's Waste Disposal Rates and Services" is attached. Flood Control The subject territory is located within the "Y" drainage area of the Fresno Metropolitan Flood Control District. There are no permanent FMFCD drainage facilities located in the vicinity of the project area at this time, however, the storm drainage collection system, when constructed, will provide a level of protection from rainfall intensities up to a two-year frequency (this equates to a 'Level of rainfall which has a 50 percent chance of occurring in any given year). Provision of a storm drainage facility can only be accomplished through the formation of an improvement district to finance the project. Temporary on -site facilities could also be required as part of private development proposals.
