RESOLUTION OF THE COUNCIL OF TEE; CITY OF FRESNO APPLYING TO
THE FRESNO LOCAL AGENCY FORMATION C014MISSION IN THE MATTER OF
THE PROPOSED HERINDON-FRESNO NO. I-C DISTRICT REORGANIZATION,
INCLUDING THE DETACHMENT OF CERTAIN TERRITORY CONSISTING OF
20.91 ACRES FROM THE MID VALLEY FIRE PROTECTION DISTRICT AND
THE ANNEXATION OF SAID TERRITORY TO THE CITY OF FRESNO
WHEREAS, this proposal is made pursuant to the District Reorganization
Act of 1965 contained in Division I of Title 6 (commencing with Section 56000)
of the California Government Code; and
WHEREAS, the nature of the proposed change is a reorganization consisting
of the detachment of certain territory consisting of 20.91 acres and hereinafter
called the "subject territory" from the Mid Valley Fire Protection District and
the annexation of the subject territory to the City of Fresno; and
WHEREAS, no other counties, cities, or districts are affected; and
WHEREAS, the subject territory proposed to be detached from the Mid Valley
Fire Protection District and annexed to the City of Fresno is uninhabited, is
described in attached Exhibit "A" and graphically depicted upon the map marked
Exhibit "B", and by these references made a part of this resolution- and
WHEREAS, review and analysis of Environmental Assessment No. 2470 related
to said district reorganization project has resulted in filing of a Negative
Declaration by the Director of Planning and inspection; and
WHEREAS, pursuant to the requirements set forth in Government Code Section
35102, a service plan for the subject territory has been pre -pared and said service
plan is attached hereto as Exhibit "C", and by this reference made part of this
resolution; and

WHEREAS, no new districts are proposed to be formed by this reorganization;
WHEREAS, the Fresno County Assessor's roll will be used for the purpose of
levying any assessments or taxes on the subject territory; and
WHEREAS, the subject territory nroposed to be annexed to the City of Fresno
will be exempted from taxation for the payment of principal or interest, or any
other amounts which shall become due on account of any outstanding bonded indebt-
edness incurred by the City prior to the effective date of such annexation, and
upon completion of this reorganization proposal, the subject territory will be
included in Municipal Bond Area I'D" and will not be taxed for any existing bonded
indebtedness or contractual obligations; and

WHEREAS, the reasons for this proposal are stated as follows.

tion for this Negative Declaration is;
This Negative Declaration is in part, supported with information obtained from comparlson of
the magnitude of the characteristics of the proposed project with previously assessed projects
having similar characteristics for which Negative Declarations were justified.
The proposed project represents an incremental step in the continuing process of the develop-
men-L of land within urbanizing areas of the City of Fresno and is in itself, not a major
action. Therefore, any potential adverse effects on the environment that may be attributable
to this project during and after -implementation are not of sufficient duration, magnitude and
concentration to be substantial.

Pursuant to Article 5, Chaptet 12, of the Fresno Municipal Code
and Section 15080 of the State EXR Guidelines, the environmental
finding indicated below has been determined for the project
descr±bed generally as:

possibility of significant effect on the environment resulting from the subject
project, pursuant to Section 15060, State EIR Guidelines.
5. INSUFFICIENT INFORMATION: Environmental review and analysis summarized herein has

an Environmental .Impact Report is required. Upon submission of information on the
deficiencies listed her i , the project will be re-evaluated and the env rontOntal

Comments in this finding of the relatedness of plans and policies of the City are sub-
stantivo environmental considerations but do not determine conformity or non -conformity
of the proposed project to such plans and policies apart from other: considerations.

SUMMARY ENVIRONMENTAL FINDING
(For 1, 1A, and 2 above, the following summary includes comments on moderate and
major environmental effects and those marks with an asterisk on Page 4)
The proposed project is the Herndon --Fresno No, 1-C District Reorganization/
Annexation involving the detachment of 20.91 acres from the Mid Valley
Fire Protection District and annexation of the sane to the City of Fresno.
The subject territory is currently zoned R-A, and consists of two vacant
parcels including one vacant residence. The subject territory as general-ly
located on the east side of North Fresno Street between East Herndon and
East Alluvial Avenues.
ANALYSIS --The proposed project consists of a change in jurisdiction over
approximately 21 acres, and, in itself, will not result in any -direct
action on the physical environment. Upon annexation the responsibility
for planning policy and land use regulation will be assumed by the City of
Fresno. The subject territory is designated by the Woodward Park Community
Plan as appropriate for medium-bigh density residential uses. The unadopted
Alluvial/First Area Specific Plan recommends that the easterly portions
of the subject territory be developed as a community park/ponding basin and
that the portion of the subject territory to the west of the proposed
Forth Fresno Street alignment be developed to medium --high density resi-
dential uses (R-2/UGM standards). On the basks of the Woodward Park
Community Plan land use designations, a potential of 100 to 190 dwelling
units could ultimately develop on the subject territory. Development
in conformity with the land use recommendations of the Alluvial/First
Area Specific Plan would yield approximately 60 dwelling units, The followinf
analysis is based upon potential urbanization -in accordance with the Woodward
Park Community Plan,
12.0, 7,05 2.1, 6,0--Potential urbanization of the subject territory would
generate approximately 2000 additional average daily vehicular tMips.
As indicated in the Woodward'Park Community Plan, the Preliminary
Alluvial/First Area Specific Plan and the Service Plan for the proposed
DR/A, a major modification of the existing street system will be required
through the establishment of a new North Fresno Avenue alignment, under
the Urban Growth Management policy, construction of the two center travel
lanes and the two four -foot shoulders of the new alignment of North Fresno
Street will be required in conjunction with future development of the sub-
ject territory.
The subject territory is adjacent to the alignment of the proposed Freeway
41. Future residential development of the subject territory could be
affected by localized pollution and noise associated with Freeway traffic.
A designated 200 -foot open space transition designated by the Woodward
Park Community Plan and the proposed Alluvial/First Area Specific Plan
will serve to mitigate such effects. In itself, potential urbanization
of the sub jest territory will result in minor sncreental increases in
automobile exhaust emissions and noise,, including noose normally associated
with multiple -family residential development.
2.3� 3.1., 13. S--The increases in total paved surface area normally associ-
ated with multiple -family developments will result in increases in midday
surface temperatures and increases in surface stormwater runoff, The
Fresno Metropolitan Flood Control District will be the agency responsible
for providing a stormwater drainage system to serve the subject territory.
However, due to i.r1sufficlent development within the watershed of of drainage
district "CN" it is estimated that the system, will not be constructed
for at least two to five yF�ars. The estimated cost of the facilities

on -site ponding basins will be required as development occurs within
the subject territory, in addition to the construction of some
District Master Plan pipeline facilities. The District recommends
that development be restricted to R-2 standards, in order to control
the intensity of runoff from future development.
Increases in midday surface temperatures can be mitigated through
application of the Fresno Muncipal Code (Subsection 24 (g) (3) of
Section 12-30e-N),which requires that one medium --sized tree be planted
for each required parking space, plus one medium-sized tree for each
residential unit.
3.35 3'4' 13,b--The development of the subject territory in accordance
with planned sand uses would result in the withdrawal of an estimated
185 acre-feet of groundwater per year. In terms of the volumes involved
in the Fresno aquifer system, the projected effects are not considered
significant. As indicated in the DR/A Service Plan, future development
of the subject territory will require the extension of a transmission
grid main in the "new" North Fresno Street alignment from an existing
water main in North Fresno Street approximately 0600 feet south of
East Herndon Avenue, as well as the dedication of a water well site
and the development and installation of a City water supply well .

13.1--The Fire Department has indicated that fire protection can be
furnished to the subject territory subject to the following (1) in-
stallation of fire hydrants and water mains meeting Fresno City
specifications for required fire flow and spas ing, and (2) street
accesses and widths are maintained to Fresno City standards.
13.7--Sewer service to the subject territory will be provided through
tie UGM process, Future development of the subject site will require
the extension of a sewer main in the new North Fresno Street alignment
from a connection with the Herndon Avenue interceptor,
-13.5--The subject territory is located within the Clovis Unified
School District. Future urbanization of the subject territory could
have cumulative effects on the provision of school services by the CUSD.
Potential urbanization of the subject territory could generate approxi-
mately e0 elementary students, 17 junior high and 19 high school
students.
13.91--The amended Service Plan for the proposed D /A indicates that
the parks and recreation needs of the subject territor vaill riot12e
adequately met with existing facilities. Furthermore, the proposed
subject territory is indicated as the proposed location for a
neighborhood park site to serve the immediate surrounding area. The
Perks and Recreation Department has expressed concerns that the parks
and recreational needs of the area will be urmet, should the subject
territory be developed with alternative uses. The Parks and Recreation
Department states that condemnation proceedings on this site may be
necessary, The impact of not acquiring the subject territory; for a
park site (or acquiring an alternative site) ;s considered substantial
bT the Parks and Recreation Department.
PRELIMINARILY PROPOSED DEVEEOP14ENT--Environmental Assessment No. 2274
and Urban Growth Management Application No. 53 relating to proposed
Tentative Tract Map No. 3001 have been submitted to the City for
analysis in July 1977, but have been suspended pending initiation
of annexation proceedings. Tentative Tract Map NO. 3001 proposes
a local street system (East Spruce, East Locust and Lest Fir Avenues),
a 40-foot wide frontage road, and an extension of North Fresno along
the proposed new alignment. The proposed tentative tract map consists
of 51 R-2 lots (allowing approximately 3 dwelling units per lot) and
one large R-3 lot of approximately 3.7 acres (allowing approximately
75 to 100 dwelling units). The applicant has :indicated intentions to
develop approximately 200 dwelling units. The proposed tentative tract
map is generally consistent with the land use designations of the
Woodward Park Community Plan, but could -nave potential adverse cumulative
effects on the provision of recreational facilities in the subject
territory area (see 13.91 above).i*`r

SERVICE PLAN
This service plan is prepared in accordance with the requirements of Government
Code Section 35102. Each major service subject is discussed based on existing
conditions and adopted City plans and policies. The purpose of this document is
to provide information regarding the availability of City services, and how they
will be provided to the subject territory should annexation to the City occur.
Project Summary
The proposed district reorganization consists of two parcels containing approxi-
mately 21.8+ acres and is generally located northeast of Herndon and Fresno Avenues.
The subject territory is located within the City of Fresno's adopted Urban Growth
Management Area, and will be subject to UGM requirements. The proposed district
reorganization involves the detachment of the entire 21.8+ acres from the Mid.
Valley Fire Protection District and the annexation of the same territory to the 3,

City of Fresno. The subject territory is zoned R-A, and contains one abandoned
single family dwelling.
Sewer
At the present time no sewer service is being provided, however, should development
occur within the area, sewer services will become available from an existing mein
located south of Herndon Avenue in Fresno Street. Extension.$ to this sewer main
will be at the developer's costs.
Water
There .are no water services being provided to the subject area at this time, however,
should development occur in the near future water service could be provided by the
Pinedale County Water District on an interim basis. Eventually all services east

of the proposed Freeway 41 will be provided by the City of Fresno.
Fire Hydrants
There is one fire hydrant located on the northwest corner of the intersection
East Herndon and North Fresno Avenues, approximately 550 feet south of the project
area. Upon annexation all fire hydrants will be installed to City standards at
600 feet intervals within residential areas, or at 450 feet in areas where resi-
dential units are heavily concentrated. Installation of fire hydrants will be
off minimum 6-inch water mains, with a water flow of 1,500 gallons per minute at
20 pounds residual water pressure.
Police Protection
Police protection service will be provided upon annexation. These protective
services will be provided at the same level as those being provided throughout the
existing incorporated City area.
Fire Protection
The subject territory is presently receiving fire protection services from the Kid
Valley Fire Protection District Station No. 20 located near the intersection of
North First Street and East Herndon Avenue, approximately one mile east of the
subject area. The area proposed for annexation will receive City fire protection
upon annexation. First due response will come from City Fire Station No. 11
located approximately 1.8 miles south of the project area.
Paramedic Service
Paramedic services are currently being provided by the Mid Valley Fire Protection
District and the City of Fresno through an Instant Response Agreement. Services
can be provided to the subject territory from either Mid Valley Station No. 20 or

City Fire Station No. 11.
This condition will not change upon annexation.
Street Lighting/Traffic Signalization
It is anticipated that two 70-watt street lights will be installed on North Fresno
Avenue adjacent to the project area. Upon annexation the City of Fresno will assume
energy and maintenance costs for all street lights installed. The installation of
traffic signals is not anticipated at this time.
Traffic Engineering/Street Improvements
North Fresno Avenue is located within the project area. North Fresno Avenue is
an unimproved local street and will require additional road right-of-way, curbs,
gutters, sidewalks, and permanent pavement.
Street Sweeping
Street sweeping will be provided to the area upon annexation conditioned upon the
installation of permanent paving, concrete curbs, gutters, and sidewalks. Due to
the passage of Proposition 13, the frequency of street sweeping services is uncertain.
Transit Service
Fresno Transit Routes Nos. 30 and 34 are the closest routes to the project area.
Route 30 travels north and south on Blackstone Avenue and Route 34 travels north
and south on First Street. Service is provided on the basis of 30-minute intervals
with 15-minute intervals during peak hours. The Handy Ride program now serving
eligible residents of the area will continue following annexation.
Parks and Recreation
The parks and recreation needs of the proposed area of annexation are being partially
met through existing facilities, and will be more effectively met with the develop-
ment of proposed facilities. The day-to-day playfield needs of the area are being
met through the use of the Pinedale Elementary School facilities.

The neighborhood park needs of the area will be adequately met, as defined by
Department standards, when a parksite is acquired and developed in the general
location of Alluvial, between Fresno and First. The acquisition of a parksite
in.this vicinity is included in the Department's Five -Year Capital Improvement
Program, and is anticipated for FY 1978-79.
The regional park needs of the area can be met through Woodward Park. The community
recreation center needs of the area can be net when the Department's standard of one
center per neighborhood park area is met. The Department plans to address the
community recreation center needs through the City's Capital Improvement Program.
Animal Control
There are no differences in the level of animal control services provided by the
Society for the Prevention of Cruelty to Animals throughout the Fresno Metropolitan
Area. This fact results from similar contracts with the Society with both the
County and the City.
Utility Tax
The City's 4.6 percent utility tax would be applicable to all natural gas, elec-
tricity, and telephone bills. The actual cast of such tax could be estimated by
relating this tax rate to current utility bills.
Property Tax

Due to the passage of Proposition 13, no change in property tax is anticipated.
Solid Waste Disposal
State law provides that private waste disposal services may continue for a period
of up to five years from the date an area is annexed to the City according to the
conditions listed below. otherwise, services must be obtained from the City's
Waste Disposal Division. In any event, the customer must convert to City Waste
Disposal services witNnfive years of the date of annexation.
1. The company must have been licensed by the County of
Fresno for a minimum of three years. This includes;
Cannon Disposal Service, Browning -Ferris Industries
of California, Inc-, Industrial Waste and Salvage Co.
(IwS), Fresno Disposal, Fresno Roll -Off Service, and
Thrifty Best Rubbish Service.
2. The customer is not allowed to change from one disposal
company to another only to the city's Waste Disposal
service.
3. The quality and frequency of service of the private
company must meet the standards required by the City
of Fresno. An information sheet on City's "Waste
Disposal Rates and Services" is attached.
Flood Control
The Fresno Metropolitan Flood Control District would provide the storm drainage
system to serve the subject territory as well as the surrounding territories. Vho
storm drainage collection system, when constructed, would provide a level of pro-
tection from rainfall intensities up to a two-year frequency (this equates to a
level of rainfall which has a 50 percent chance of occurring in any given year).
The basin storage capacity will provide protection for up to a 100-year flood
(this is translated as a level of flooding with a 1 percnit chance of occurring
in any given year). However, due to insufficient development within the watershed
of which the current proposal is a part, it is estimated the storm drainage system
could not be constructed for at least two to five years. The current estimated
cost required to construct the storm drainage system is $200,000.
