A RESOLUTION DETERMINING TO PROCEED
WITH SPECIAL ASSESSMENT PROCEEDINGS
FOR CONSTRUCTION OF IMPROVEMENTS
AND DETERMINING THAT THE PROVISIONS
OF DIVISION 4 OF THE STREETS AND
HIGHWAYS CODE SHALL NOT APPLY
ASSESSMENT DISTRICT NO. 80
RESOLVED, by the Council of the City of Fresno,
California, as follows.
WHEREAS, a petition signed by owners of property subject
to assessment for the proposed improvements within the territory
shown on Exhibit "A" attached hereto and by reference incorporated
herein has been filed with the City Clerk of the City of Fresno,
which said territory and its exterior boundaries thereof are also
shown on the map of a proposed assessment district designated
Assessment District No. 80 on file in the office of said City
Clerk; and
WHEREAS, the Engineer to wham the petition was referred
has filed his certificate that said petition is signed by all of
the owners of more than 60% in area of the property subject to
assessment for the proposed improvements and that said petition is
sufficient.
NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED,
AS FOLLOWS.
1. The Certificate that the Petition for Improvements
Exceeds 60%r be, and it is hereby, accepted and approved.
2. That jurisdiction exists for the conduct of special
assessment proceedings for construction of improvements in the
territory hereinbefore described and the provisions of Division 4
of the Streets and Highways Code of the State of California shall
not apply to said proceedings and such proceedings shall not be
conducted.

hereby certify that the foregoing resolution was regularly
introduced and adopted by the City Council of the City of Fresno at
