R33SOLUTION NO. 7 9 - 2 3 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO APPLYING TO THE FRESNO COUNTY LOCAL AGENCY FOR- MATION COMMISSION IN THE MATTER OF THE PROPOSED INDIANAPOLIS-GLENN NO. 4 DISTRICT REORGANIZATION, INCLUDING THE DETACHMENT OF CERTAIN TERRITORY CONSISTING OF 4.43 ACRES FROM THE NORTH CENTRAL FIRE PROTECTION DISTRICT AND THE ANNEXATION OF SAID TERRITORY TO THE CITY OF FRESNO WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Government Code; and WHEREAS, the nature of the proposed change is a reorganization consisting of the detachment of certain territory consisting of 4.43 acres and hereinafter called the "subject territory" from the North Central Fire Protection District and the annexation of the subject territory to the City of Fresno; and WHEREAS, no other counties, cities,, or districts are affected; and WHEREAS, the subject territory proposed to be detached from the North Central Fire Protection District and annexed to the City of Fresno is uninhabited, is de- scribed in attached Exhibit "A" and graphically depicted upon the map marked Exhibit "B", and by these references made a part of this resolution; and WHEREAS, by notice of Exemption No. 2600 said district reorganization project was determined to be categorically exempt from the preparation of environmental documents; and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the subject territory has been prepared and said service plan is attached hereto as Exhibit "c", and by this reference made part of this re- solution; and WHEREAS, no new districts are proposed to be formed by this reorganization; and WHEREAS,, the Fresno County Assessor's roll will be used for the purpose of levying any assessments or taxes on the subject territory; and WHEREAS, the subject territory proposed to be annexed to the City of Fresno will be exempted from taxation for the payment of principal or interest, or any other amounts which shall become due on account of any outstanding bonded indebted- ness incurred by the City prior to the effective date of such annexation, and upon completion of this reorganization proposal, the subject territory will be included in Municipal Bond Area "D" and will not be taxed for any existing bonded indebtedness or contractual obligations; and WHEREAS, the reasons for this proposal are stated as follows: 0> -FECT Sig, Page I of 2 • 0 1. Annexation of the subject territory to the City of Fresno will result in improved land use planning. All private development controls of the City will apply,, following reorganization. 2. The subject territory is within the City of Fresno's Sphere of Influence. 3. The consolidation of the subject area into one detachment annexa- tion project is beneficial to the affected governmental processes and the resultant City and district boundaries. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno here- by requests that proceedings be taken by the Fresno County Local Agency Formation Commission for the herein proposed Indianapolis -Glenn No. 4 District Reorganiza- tion, including the detachment of the subject territory, consisting of 4.43 acres from the North Central Fire Protection District and the annexation of the same territory to the City of Fresno. SCA�E3 /...2Qn' LXIIIBIT "B" INDIANAPOLIS-GLENN NO. 4 DISTRICT REORGANIZATION SERVICE PLAN December 15, 1978 This service plan is prepared in accordance with the requirements of Government Code Section 35102. Each major service subject is discussed based on existing conditions and adopted City plans and policies. The purpose of this document is to provide information regarding the availability of municipal services and how they will be provided to the subject territory should annexation to the City occur. Any required modification, expansion or extension of existing facilities in order to serve the subject territory will be discussed based on applicable City ordinances. Where appropriate, the financing and placement of services and facilities will also be discussed. Summary The proposed Indianapolis -Glenn No. 4 District Reorganization consists of the annexation of 4.43 acres to the City of Fresno and the detachment of the same 4.43 acres from the North Central Fire Protection District. The area proposed for annexation is partially contiguous to the City along its eastern and southern boundaries. The subject territory falls within the City's Sphere of Influence boundary and is generally located on the east and west sides of North Glenn Avenue between East Indianapolis and 'East Gettysburg Avenues. Existing land use consists of eight single family dwellings. The area is zoned R-1 and R-2-A. The subject territory is located within the Bullard Community Plan which designates medium high density residential development as the appropriate land use for the area and the Glenn Avenue Land Use Policy which specifies one story multiple development as appropriate. Sewer The subject territory is served by the City of Fresno sanitary sewer system. No modifications will be required to continue to provide the present level of service. upon annexation the monthly residential sewer service rate of $2.40 will apply with a savings of $1.20 per month per residence. Property owners paying for two units will have their monthly sewer rate reduced to $4.50, a savings of $2.25 per month. Water County Waterworks District No. 16 provides service to the area proposed for annexation. Ths costs of water service will not be affected by annexation. Fire Hydrants One wharf type fire hydrant., situated at the intersection of East Indianapolis and North Glenn Avenues, is located within the subject territory (see the water EXHIBIT " C "' -2- service map for other hydrants in close proximity to the subject property). Since the subject territory is entirely within the County Waterworks District No. 16 area of responsibility, the City will have no fire hydrant or fire flow water characteristics responsibilities upon annexation. Fire Protection The subject territory is presently receiving fire protection services from the North Central Fire Protection District. First due response is from North Central Station No. 7, located on West Bullard Avenue between Fruit and West Avenues. This station is located approximately 3.3 miles from the nearest point of the subject territory and 3.4 miles from the farthest point. Upon annexation the area will receive City Fire Protection Services. First due response will be provided by City Station No. 11, located at the intersection of Fresno and T%Trenwood Avenues. This station is situated approximately 1.7 miles from the nearest point of the -subject territory and 1.8 miles from the farthest point. Paramedic The North Central Fire Protection District provides paramedic services from its Station No. 7. Upon annexation the City will provide the services from City Station No. 11. Police Protection The subject territory is presently being served by the Fresno County Sheriff's Department and the California Hig'hway Patrol. Upon annexation, City police pro- tection will be provided at the same level as the service now being provided within the City's incorporated area. Street Sweeping Monthly street sweeping services will be provided to the subject territory upon annexation conditioned upon the installation of permanent paving and concrete curbs and gutters. Concrete improvements already in place entitle assessor's Parcel Number 426-092-10 to immediate street sweeping services upon annexation. Street Lighting/Traffic SigEalization No streetlights currently exist within the subject territory. City of Fresno standards will ultimately require the installation of four 70- watt high pressure sodium (HPS) streetlights on the existing street frontages, three HPS lights on North Glenn Avenue and one 70-watt HPS light on East Indiana- POlis. Current plans.would call for these lights to be installed in one to two years. As development occurs, the developers will be required to install steel pole underground service streetlighting on all streets within and/or adjacent to the subdivision or development. These lighting requirements will be determined when final development proposals are submitted. The City will assume all energy and maintenance costs for streelighting. There are n(T traffic signals within the project area and none are proposed. The effects of Proposition 13 on the provision of these services is unknown at this time. Traffic Engineering/Street Improvements Both Indianapolis and Glenn Avenues are local streets having 60-foot rights -of -way. No public funded street improvements are currently planned for the subject area. Should development occur, the developer will be required to complete all off -site street improvements, including curbs, gutters, sidewalks, paving, streetlights and dedication of necessary rights -of -way. Transit Fresno Transit Route No. 30 presently services the subject territory. This north/ south route provides service at 30-minute intervals (15-minute intervals at peak hours) between Pinedale and West Fresno via Blackstone Avenue. Handy Ride services will continue to be provided to qualified residents and will not be affected by the annexation. Solid Waste Disposal The residents/property owners within the subject area are receiving private solid waste disposal services. Upon annexation City Waste Disposal services will become available to the resi- dents/property owners within the subject area. State law provides that private solid waste disposal services may continue for a period of up to five years from the date an area is annexed to the City, pro- viding these services meet conditions 1 through 3 below. otherwise, services must be obtained from the City's Waste Disposal Division. In any event, conversion to City Waste Disposal services must occur within five years of the date of annex- ation. 1. The company must have been licensed by the County of Fresno for a minimum of three years. This includes: Cannon Dis- posal Service; Browning -Ferris industries of California; Fresno Roll -Off Service; and Thrifty Best Rubbish Service. 2. A customer cannot change from one disposal company to another; only to the City's Waste Disposal Service. 3. The quality and frequency of services of the private com- -4- pang must meet the standards required by the City of Fresno. An informational sheet on the "City's Waste Disposal Rates and Services" is attached. Parks and Recreation The one -mile neighborhood park and recreational needs of the service area, as defined by Parks and Recreation Standards, will be adequately met through utiliza- tion of the Cary Park Facility, situated approximately one-half mile from the subject territory. The regional park needs of the area are adequately met through use of Woodward Park facilities. Flood Control Flood control facilities are provided by the Fresno Metropolitan Flood Control District which is responsible for all storm drainage facilities within the Fresno - Clovis Metropolitan Area. The subject territory falls within the District's "AA" drainage zone and is served by the ponding basin at the intersection of North Glenn and East Indianapolis Avenues. Animal Control There are no differences in the level of animal control services provided by the Society for the Prevention of Cruelty to Animals throughout the Fresno Metropolitan Area. Utility Tax The City's 4.6 percent utility tax will be applicable to all natural gas, electric- ity and telephone bills. The actual cost of such tax can be estimated by relating this tax rate to the current utility bills. 0 Property Tax With the passage of Proposition 13, City and County property taxes are identical. Thus, annexation to the City of Fresno will cause no property tax increase to the property owner. The $3-95 monthly rate includes a weekly collection of one 30 gallon can of kitchen and table refuse, paper, glass, packing material, rags and other refuse involved in the handling or preparation of food. In addition, rubbish of up to one cubic yard, (six 30 gallon cans) including newspapers, eree limbs, grass clippingst brokon toyso bottles, etc.0 will also be collected each week. SPECIAL MAULS: $29.40 per hour, with a minimum charge of $7.35 for the first quarter hour or fraction thereof.
