HomeMy WebLinkAboutResolution - City Council - 79-016 - 1979-01-16U E d D 1 i c h� RESOLUTION NO. - RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO APPLYING TO THE FRESNO LOCAL AGENCY FORMATION COMMISSION IN THE MATTER OF THE PROPOSED SAMSON- FIG NO. 4 DISTRICT REORGANIZATION, INCLUDING THE DETACHMENT OF CERTAIN TERRITORY CONSISTING OF 7.62 ACRES FROM THE KID VALLEY FIRE PROTECTION DISTRICT AND THE ANNEXATION OF SAID TERRITORY TO THE CITY OF FRESNO WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Government Code; and WHEREAS, the nature of the proposed change is a reorganization consisting of the detachment of certain territory consisting of 7.62 acres and hereinafter called the "subject territory" from the Mid Valley Fire Protection District and the annexation of the subject territory to the City of Fresno; and WHEREAS, no other counties, cities, or districts are affected; and WHEREAS, the subject territory proposed to be detached from the Mid Valley Fire Protection District and annexed to the City of Fresno is uninhabited., is described in attached Exhibit "A" and graphically depicted upon the map marked Exhibit "B", and by these references made a part of this resolution; and WHEREAS, review and analysis of Environmental Assessment No. 2497 related to said district reorganization project has resulted in a filing of a Negative Declaration by the Director of Planning and inspection; and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the subject territory has been prepared and said ser- vice plan is attached hereto as Exhibit "C", and by this reference made part of this resolution; and WHEREAS, no new districts are proposed to be formed by this reorganization; WHEREAS, the Fresno County Assessor's roll will be used for the purpose of levying any assessments or taxes on the subject territory; and 147HEREASF the subject territory proposed to be annexed to the City of Fresno will be exempted from taxation for the payment of principle or interest, or any other amounts which shall become due on account of any outstanding bonded indebt- ness incurred by the City prior to the effective date of such annexation, and upon completion of this reorganization proposal, the subject territory will be included in Municipal Bond Area "D" and will not be taxed for any existing bonded indebtedness or contractual obligations; and Page I of 2 Pages a vmEREAS, the reasons for this proposal are Mated as follows:. 1. Annexation of the subject territory to the City of Fresno will result in improved land use planning. All private development controls of the City will apply, following reorganization. 2. The subject territory is within the City of Fresno's Sphere of Influence. 3. The consolidation of the subject area into one detachment -annexation project is beneficial to the affected governmental processes and the resultant City and district boundaries. SCALE= EXHIBIT "B" SAMSaN-FIG No. 4 DISTRICT REORGANIZATION SERVICE PLAN October 30, 1978 This service plan is prepared in accordance with the requirements of Government Code Section 35102. Each major service subject is discussed based on existing conditions and adopted City plans and policies. The purpose of this document is to provide information regarding the availability of City Municipal services and how they will be provided to the subject territory should annexation to the City occur. Any required modification, expansion, or extension of existing facilities in; order to serve the subject territory will be discussed based on applicable City ordinances. Where appropriate the financing and placement of services and facilities will also be discussed. Summary I l The proposed Samson. -Fig No. 4 District Reorganization consists of the annexation of 7.62 acres to the City of .Fresno and the detachment of the same 7.62 acres from the Mid Valley Fare Protection District. The area proposed for annexation 4 is contiguous to the City along its easterly and southerly boundaries. The sub- ject territory falls within the Cites Sphere of Influence boundary and is generally located northwest of the intersection of East Samson and South Fig Avenues. Existing land use includes two single family dwellings, a church, and vacant land. The area is zoned R-A. The subject territory is located within the Edison Corm-aunity Plan and the South- west Fresno General Neighborhood Renewal Area Plan which designate medium -low density residential development as the appropriate land use for the area. Sewer The two existing residences and the church are currently served by individual septic systems. A 15-inch City sanitary sewer main located in South Pig Avenue and an 8-inch main located in East Samson Avenue will servo the project area. The existing dwellings and the church will be required to conuec:t to this system within three years of the date the territory is annexed to the City of Fresno, while the vacant parcels within the project area will be required to connect to the City sanitary sewer as they develop. Construction of sewer mains, connections, frontage charges, and other appropriate fees will be the responsibility of the property owners or their developer. Water i 1 The City of Fresno Water System serves the church located within the subject terri- tory, while the two dwellings are presently served by private wells located on the 1 premises. City water service is available from the existing 12-inch water main located in South Fig Avenue and the 6-inch main located in East Samson Avenue. Construction of on -site facilities plus all applicable acreage and frontage charges will be the responsibility of the property owners or developers at such time that EXHIBIT "C" 3 new development occurs. Those parcels presently served by private wells may continue to use these wells until such time as they require major renovation (deepening, new cases, etc.), at which time the property owners will be required to connect to the City's water, system. Fire Hydrants There are no existing fire hydrants situated within the subject territory, however, three City water system hydrants are situated on the perimeter roads to the east and south of the proposed annexation area (see water service map). All future fire hydrants required as conditions of development will be installed to City of Fresno standards at: the expense of the developer. Such standards also include the requirement for sufficient water pressures for fire suppression. Fire Protection The subject territory is presently receiving fire protection services from the Mid Valley Fire Protection District. First due response is from Mid Valley Station No. 7 located at the intersection of East Drummond and South Sierra Vista Avenues. This station is located approximately 4.1 miles from the nearest point of the subject territory and 4.3 miles from the farthest point. Upon annexation the area will receive City fire protection services. First due response will be provided by City Station No. 7 located at the inter'seotion of East Church and South Holly Avenues. This station is situated approximately 1.9 miles from the nearest point of the subject territory and 2.1 miles from the farthest point. Paramedic Paramedic services are currently provided based on an instanit. Response Agreement between the City and the Mid Valley Fire Protection District with first due response coming from City Station No. 3 located at the intersection of Fresno and "E" Streets. Station No. 3 is situated approximately 2.8 miles from the nearest point of the project area and three miles from the farthest point. This service will not be affected by annexation. Police Protection The subject territory is presently being served by the Fresno County Sheriff's Department and the California Highway Patrol. upon annexation City police protec- tion will be provided at the same level as the service now being provided within the City's incorporated area. Street Sweeping Weekly street sweeping services will be provided to the subject territory upon I AWL s annexation conditioned upon the installation of permanent pavements concrete curbs, and gutters. Due to the passage of Proposition 13, the frequency of street sweeping services is uncertain Street Lighting/Traffic Signali.zati.on No street lights currently exist within the subject territory. Tvyo street lights are situated adjacent to the subject property on South Fig Avenue. City of Fresno standards will ultimately require the installation of lC--watt high pressure sodium (HPS) street lights at the Fig/Edgar and Fig/Samson inter- sections, two 70-watt HPS lights on Fast Samson Avenue, and two additional 70- watt HPS lights on South Fig Avenue.. As development occurs the developers will be required to install street lighting on all streets within and/or adjacent to the subdivision or development. These lighting requirements -will be determined when final development proposals are submitted. The City will assume all energy and maintenance cosh for street sighting. There are no traffic signals within the project area and none are planned at this time. i The long terra effects of Proposition 13 on the provision of these services are unknown at this time. Traffic Engineering/'Street Improvements South Fig Avenue is designated, a 70-afoot three lane col lector r while East Samson Avenue is designated a 60-foot Local. street. Both streets are currently two lanes where they front the subject territory. No modifications are presently planned. Installation of concrete curbs, gutters, si.dec-calks, permanent paving, and dedication of rights-of-waywill not be reTa red as a result of annexation except on parcels when they are developed. l Transit. Services f f Fresno Transit Route No. 26 presently serves the subject territory. This north/ south route provides service at 30-minute intervals U5-minute intervals during peak hours) between North./Fig and Herndon/Palm vi.a. Downtown Fresno. Handy Ride services will continue to be provided to qualified residents and will not be affected by the annexation. -4- Solid Waste Disposal The residents/property owners within the subject area are receiving private solid waste disposal services. Upon annexation City waste disposal services will become available to the residents/property owners within the subject area. State law provides that private solid waste disposal services may continue for a period of up to five years from the date an area is annexed to the City providing these services meet conditions I through 3 below. Otherwise, services must be obtained from the City's Waste Diposal Division. In any event conversion to City Waste Disposal Services must occur within five years of the date of annexation. 1. The company must have been licensed by the County of Fresno for a minimum of three years. This includes: Cannon Disposal Service, Browning -Perris Industries of California, Fresno Roll -off Service, and Thrifty Best Rubbish Service. 2. A customer cannot change from one disposal company to another only to the City's Waste Disposal service. 3. The quality and frequency of services of the private company must meet the standards required by the City of Fresno. An informational sheet on the "City's Waste Disposal Rates and Services" is attached. Parks and Recreation The one -mile neighborhood park and recreational needs of the project area, as defined by Parks and Recreation standards, are adequately met through utiliza- tion of Ivy Community Center. The regional park needs of the area are ade- quately met through the use of Roeding Park facilities. Flood Control There are no existing flood control facilities at this time. Flood control facilities, when constructed, will be provided by the Fresno 1.`4etropolitan Flood Control District (FMFCD) which is responsible for all storm drainage facilities within the Fresno -Clovis Metropolitan Area. The subject territory falls within the District's "CQ'I drainage zone. Animal Control There are no differences in the level of animal control services provided by the Society for the Prevention of Cruelty to Animals throughout the Fresno Metropolitan Area. Utility Tax , The City's 4.6 percent utility tax will be applicable to all natural gas, electricity, and telephone bills. Theactualcost of such tax can be estimated by relating this tax rate to the currently utility bills. Property Tax With the passage of Proposition 13, it is anticipated that City and County property taxes will be identical. Thus, annexation to the City of Fresno will cause no property tax increase to the property owner.
