HomeMy WebLinkAboutResolution - City Council - 79-015 - 1979-01-16Z1Z 1 RESOLUTION NO. 7 S", - 13 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO APPLYING TO THE FRESNO LOCAL AGENCY FORMATION C014MISSION IN THE MATTSR OF THE PROPOSED JENSEN- MAPLE NO. 1 DISTRICT REORGANIZATION, INCLUDING THE DETACHMENT OF CERTAIN TERRITORY CONSISTING OF 51.7 ACRES FROM THE MID VALLEY FIRE PROTEC- TION DISTRICT AND THE ANNEXATION OF SAID TERRI- TORY TO THE CITY OF FRESNO. WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Government Code; and WHEREAS, the nature of the proposed change is a reorganization consisting of the detachment of certain territory consisting of 51.7 acres and hereinafter called the "subject territory" from the Mid Valley Fire Protection District and the annexation of the subject territory to the City of Fresno; and WHEREAS, no other counties, cities, or districts are affected; and WHEREAS, the subject territory proposed to be detached from the Mid Valley Fire Protection District and annexed to the City of Fresno is uninhabited, is described in attached Exhibit "A" and graphically depicted upon the map marked Exhibit "B", and by these references made a part of this resolution; and WHEREAS, review and analysis of Environmental Assessment No. 2566 related to said district reorganization project has resulted in filing of a Negative Declaration by the Director of Planning and Inspection,* and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the subject territory has been prepared and said service plan is attached hereto as Exhibit "C", and by this reference made part of this resolution; and M] WHEREAS, no new districts are proposed to be formed by this reorganization; WHEREAS, the Fresno County Assessor's roll will be used for the purpose of levying any assessments or taxes on the subject territory; and WHEREAS, the subject territory proposed to be annexed to the City of Fresno will be exempted from taxation for the payment of principal or interest, or any other amounts which shall become due on account of any outstanding bonded indebt- edness incurred by the City prior to the effective date of such annexation, and upon completion of this reorganization proposal, the subject territory will be included in Municipal Bond Area "D" and will not be taxed for any existing bonded indebtedness or contractual obligations; and PASSED Page I of 2 Pages WHEREAS, the reasons for this proposal are stated as follows: 1. Annexation of the subject territory to the City of Fresno will result in improved land use planning. All private development controls of the City will apply following reorganization. 2. The subject territory is within the City of Fresno's Sphere of Influence. 3. The consolidation of the subject area into one detachment -annexation project is beneficial to the affected governmental processes and the resultant City and district boundaries. NOWT THEREFOREj BE IT RESOLVED that the Council of the City of Fresno hereby requests that proceedings be taken by the Fresno Local Agency Formation Commission for the herein proposed Jensen -Maple No. I District Reorganization, including the detachment of the subject territory, consisting -of 51.7 acres from the Mid Valley Fire Protection District and the annexation of the same territory to the City of Fresno. T E : ✓A V. /979 - I" • AOO' SERVICE PLAN JENSEN-MAPLE NO.1 DISTRICT REORGANIZATION Police Protection The area is receiving service by the Fresno County Sheriff's Department and the California Highway Patrol. Upon annexation, City police protection would be provided equal to that available to other City areas. Transit Fresno Transit Route No. 29 now provides service to the inter- section of South Maple and East Jensen Avenues. The route pro- vides service at 30 minute intervals. Handy Ride services are also currently available to qualified residents on the basis of an existing agreement between the City and County. No change in transit services will occur as a direct result of annexation. Water The subject area f-alls within the Calwa County Water District, and the District will continue to be responsbile for providing water service. The District has 8 inch water mains in South Maple Avenue with a pump station near the existing Calwa Park. The Developer would be required to construct all on -site con- nections to existing mains. He could also be required to extend and existing 10 inch main from a pump station located at Byrd and Deering Avenues approximately 10001 westward of East Grove and South Sierra Vista Avenues. This would then complete a loop system to create an improved transmission grid main design. Fire Hydrants The majority of the subject territory is currently in Agricultural uses and the need for additional fire hydrants would be determined upon the submission of development plans. Required hydrants would be installed at the expense of the developer subject to City standards. Solid Waste Disposal The Calwa County Water District provides solid waste disposal services through a contract with the Browning -Ferris Industries of California, Inc. The level of service includes: Residential Properties --Service is provided on a twice a week basis for three cans. This is curb service as opposed to the City's back- yard service. The District is in the process of revising the existing contract and expect the new rates to be somewhere between $3.75 and $3.85 per month. Commercial Properties --Service is provided on a twice a week basis at the rate of $21 per month fof a,131 cubic yard bin and $34 per month for a 3 cubic yard bin. Exhibit VV7 This service would not be affected by annexation. Flood Control The Fresno Metropolitan Flood Control District would provide the storm drainage system to serve the subject territory as well as the surrounding territories. The subject area falls within Drainaae Zone _ "H H" of FMFCD. The subject territory would be served by the pond:ing basin site located on Commerce Avenue just west of Maple Avenue. However, due to insufficient development within the watershed and develop- ment occuring prior to the 1969 legislation authorizing flood control assessment fees, the storm drainage system is not completed. As an interim measure, the subject areas would have to store storm water run-off on --site until the Fresno Metropolitan Flood'Control District could assess developing properties within watershed area for the funds necessary to construct the storm drainage system. Fire Protection The subject terrotory is presently receiving f i.re protect-i onservices from the Mid valley Fire Protection District's Station No. 7 located near Drummond and Sierra vista Avenues. This station is located approximately 1/€3 mile from the nearest point of the sub- ject territory and approximately 1/4 mile froML the farthest point. The Mid valley Fire Protection District also provides paramedic services within its Zone 10 and has an agreement with the City for the improved coordination of paramedic services The subject territory would receive City fire protection services immediately upon annexation. First due response would be provided by City Station No. 8 located just south of the intersection of South Cedar and Fast Butler Avenues. Station No. 8 is located ap- proximately 1.25 Wailes from the nearest point of the parcel. and. 1,.5 miles to the farthest point. The subject territory falls within the City's two-mile standard service distance as adopted as part of the City' s urban Growth Management Process. The City will pro- vide paramedic services immediately upon annexation. At the time of new development, the Calwa County Water District would be requested to obtain fire flow water pressures and hydrants to meet Fresno City specifications. The improvements necessary to accomplish this would be evaluated and required as a condition of any private development and the cost would be borne by the developer. Street Swee�aing Street sweeping services will be provided after annexation whenever permanent paving and concrete curbs and gutters are installed. N, Streets 1:1 Jensen Avenue is a limited access expressway which is completely developed and will require no additional improvements where it abutts the subject territory on the south. However, there is no access to Jensen Avenue at this point. South Maple Avenue is a four lane col- lector that will require the installation of concrete curbs, gutters, and sidewalks when development occurs. These improvements will be at the expense of the various property owners and will occur when - properties develop or when a street improvement district is funded for such work. All street lighting will be required to conform to City of Fresno standards. This area is partially adjacent to Fresno County Service Area No. 18. This entity provides street lighting services and is located south of Church Avenue immediately east and west of portions of the subject area. Sewer The City of Fresno will continue to provide sewer service to the subject territory from existing mains located in SoutIrMaple and East Jensen Avenues. However, future development could result in the requirement that the developer extend the existing main located in South Maple approximately 6601 south to tie into the existing 3011 main located in East Jensen. Parks and Recreation Upon annexation, both City park and recreation services and Calwa Recreation and Park District facilities will be available to the residents of the subject territory. The city offers nearby facili- ties at the East Fresno Boys Club and the Sal Mosqueda Community Center. Additional recreation services are presently scheduled at Sequoia Junior High School on south Cedar Avenue.
