RESOLUTION NO. 9"
RESOLUTION AUTHORIZING PUBLIC WORKS DIRECTOR TO GRANT
A PEPMIT TO ENCROACH INTO THE PUBLIC RIGHT-OF-WAY
IN THE 2900 BLOCK OF EAST BUTLER AVENUE
WHEREAS, Diel Brothers, a general partnership, desires
to obtain an encroachment permit in order to construct a
concrete footing in the 2900 Block of East Butler Avenue,
as shown on the attached Exhibit "A°" and
WHEREAS, the aforesaid footing will not interfere with
vehicular traffic, and
WHEREAS, other affected City Departments and Public
Utility Companies have been contacted and have provided
assurance that they have no objection to the proposed en-
croachment and
WHEREAS, Notice of Exemption No. 2552 has determined
that the proposed encroachment will have no possibility
of significant effect on the environment; and
WHEREAS, the aforesaid applicant has executed a covenant
agreement which provides the said applicant will hold the
City of Fresno harmless from any liability resulting from
the issuance of an encroachment permit and will remove the
encroachments upon request by the City of Fresno.
NOW, THEREFORE BE IT RESOLVED by the Council of the
City of Fresno that the Public Works Director is hereby
authorized to grant Diel Brothers, a general partnership,
a permit to encroach into the East Butler Avenue public
right-of-way as shown on the attached exhibit "A".
