RESOLUTION NO. 79-2
A RESOLUTION OF THE COUNCIL OF THE CITE' OF
FRESNO, CALIrOR.N1A, AUTHORIZING THE DESTR73CTION
OF CITY RECORDS.
WHEREAS, Section 34494 of the Government Code provides,
in part;
and;
Unless otherwise provided by law, with the
approval of the legislative body by resolu-
tion and the Written consent of the city
attorney the head of a city department may
destroy any city record, document, instrument,
book or paper, under: his charge, without mak-
ing a copy thereof, after the same is no
longer required.
This section does: not authorize the destruc-
tion of
(a) Records affecting the title to real
property or liens thereon.
(b) Court records
(c) Records required to be kept by statute.
(d ) Records less than two years old..
(e) The minutes, ordinances, or resolutions
of the legislative body or of a city
board or commission.
WHEREAS, the Chief of Police, the head of the Police
Department of the City of Fresno, desires to destroy those
tape recordings identified in Exhibit "A," attached hereto and
incorporated by reference herein, and evidence envelopes con-
taining negatives, photos and. Latent fingerprint lift cards
and the contents therein covering the period from January 27,
1964, to December 31, 1969, inclusive, in accordance with the
provisions of said section; and
WHEREAS, the City Attorney has given written consent to
the destruction of ,said records by signing the Written Consent,
attached hereto as Exhibit "B" and incorporated by reference
herein.
NOW, THEREFORE, HE IT RESOLVED that the Council of the
City of Fresno, California, hereby approves the destruction
of those tape recordings attached hereto as Exhibit "A" and
any or all of those evidence envelopes containing negatives,

photos and latent fingerprint sift cards and the contents
therein covering the period from. January 27, 1964, to December 31,
1969, inclusive, in accordance with the provisions of Section
34090 of the Government Code.
