PROGRAM SUBRECIPIENT AGREEMENT FOR THE TARGETED AREA
REHABILITATION PROG RAM
This THIRD AMENDMENT TO HOME INVESTMENT PARTNERSHIPS PROGRAM
SUBRECIPIENT AGREEMENT for the TARGETED AREA REHABILITATION
PROGRAM ("Third Amendment") between the City of Fresno ("C|TY") and the Fresno
Economic Opportunities Commission ("SUBRECIPIENT') is effective as of this
ay of February 2016.
RECITALS
CITY and SUBRECIPIENT entered into an Agreement between the Fresno County
Economic Opportunities Commission and the City of Fresno regarding the Targeted Area
Rehabilitation Program effective March 3,2014, (the "Agreement"); and
SUBRECIPIENT was designated to carry-out all actions necessary to implement the
HOME Program objectives of providing and preserving affordable housing to eligible
lower income individuals and households; and
CITY and SUBRECIPIENT entered into a First Amendment to the Agreement effective
January 1 , 2015, which extended the Time of Performance to December 31, 2015; and
CITY and SUBRECIPIENT entered into a Second Amendment to the Agreement effective
September 30,2015, which extended the Time of Performance to March 1,2016; and
CITY and SUBRECIPIENT now desire to extend the Agreement, as set forth below:
NOW, THEREFORE, in consideration of the above recitals, which recitals are contractualin nature, the mutual premises herein contained, and for other good and valuable
consideration hereby acknowledge, the partíes agree that the aforesaid Agreement be
amended as follows:
AMENDMENTS
1. Section ll ("Time of Performance") of the Agreement is extended to April 30, 2016,
subject to any earlier termination in accordance with the Agreement.
2. Whenever the Agreement is referred to, it shall mean the Agreement as modified
by the Amendment, Second Amendment, and this Third Amendment. Except as
othenruise provided herein, the Agreement entered into between CITY and
SUBRECIPIENT regarding the Targeted Area Rehabilitation Program effective March 3,
2014, remains in full force and effect.
