FIRST AMENDMENT TO CONSULTANT AGREEMENT
THIS FIRST AMENDMENT TO AGREEMENT (Amendment) made and entered into
effective upon execution by both parties (Effective Date), amends the agreement between
the CITY OF FRESNO (the City), and Covino Smith & Simon, (formerly Simon and
Company, Inc.) (Consultant).
RECITALS
WHEREAS, the City and the Consultant entered into a consultant services agreement
(Agreement) on May 17, 2022, to provide compensation for professional Lobbying
representation for all relevant Federal Agencies and Departments; and
WHEREAS, the Agreement expires on April 20, 2024.
WHEREAS, the City and the Consultant desire to extend the term of the Agreement to
April 20, 2025, and increase Consultant's compensation to $70,200 per year.
AGREEMENT
NOW, THEREFORE, the parties agree that the aforesaid Agreement be amended
as follows:
1. The term of the Agreement is extended to April 20, 2025.
2. In the event of any conflict between the body of this Amendment and any exhibit
or attachment hereto, the terms and conditions of the body of this amendment shall control
and take precedence over the terms and conditions expressed within the exhibit or attachment.
Furthermore, any terms or conditions contained within any exhibit or attachment hereto which
purport to modify the allocation of risk between the Parties, provided for within the body of this
Amendment, shall be null and void.
3. Except as otherwise provided herein, the Agreement entered into by the City and
Consultant on May 17, 2022, remains in full force and effect.
