Phase I of Pilot Program for the Operation of Trolley Service
in the Department of Transportation/FAX
The City of Fresno ("City") and Amalgamated Transit Union, Local 1027 ("ATU'),
collectively ("parties"), have met and conferred and agree to the below provisions
regarding a pilot program for the operation of trolley service.
1. Revenue service operation of trolley service will be in conformance with Article
IV.K., Bus Operation, of the MOU between the City and ATU.
2. Filling Assignments
a. On the first day of each pay period, FAX will post three(3)Trolley Volunteer
Lists(one(1)each for Thursday, Friday, and Saturday trolley runs)whereby
Bus Drivers may sigh up to volunteer for a trolley assignment which-
provides service during the subsequent four(4)pay periods. FAX will assign
the trolley work assignment on Monday, 10:00 am of the week the work will
be performed. If the work is not filled due to lack of volunteer drivers, the
trolley bid for that week will be extended until 10:00 a.m. the day before
each service day.Trolley assignments shall be in addition to a Bus Driver's
regularly scheduled workweek.
i. Trolley volunteers that wish to volunteer for extra fixed route work in
addition to the trolley assignment must indicate it on the trolley sign
up list.
H. Trolley assignments will rotate based on the lowest number of Trolley
hours accumulated first up for work. If a Bus Driver is first up for
Trolley work and decides that he/she doesn't want or is unable to
work the assignment, the next Bus Driver with the lowest number of
Trolley hours in rotation will be given the assignment. At the opening
of each sign-up period, Bus Drivers will sign up based on seniority
and the rotation will begin based on seniority. Seniority shall be
defined as seniority in class based on length of continuous service
as a permanent Bus Driver.After a Bus Driver(s)on the list accepts
a trolley assignment, declines a trolley assignment, or does not
answer the department's attempt to contact the Bus Driver, the
department will proceed with contacting the next most senior Bus
Driver or the Bus Driver with the lowest number of accumulated
Trolley hours to fill trolley assignments.
iii. Bus Drivers who accept a trolley assignment are expected to work
the assignment.
3. Bus Drivers who accept a trolley assignment and are unable to work their trolley
assignment must notify the dispatcher by 10:00 a.m. the day prior to their
scheduled trolley assignment. FAX will move to the next driver in line on the
perspective volunteer list based on the criteria listed in 2a.ii.. Eiigibiiity to lNork a
Trolley Assignment
a. Bus Drivers may only sign up to work a trolley assignment on a day(s)which
is their regularly scheduled day(s)off.
b. Bus Drivers may only accept a trolley assignment if they have drive time
hours available pursuant to CA Code of Regulations Title 13 Part 1212.5.
c. Working a trolley assignment must not preclude a Bus Driver from working
their next day's regular scheduled work, i.e., the Bus Driver must observe a
nine(9)hour rest period between a trolley assignment and their next regular
scheduled work.
d. Notwithstanding the above,the Director of Transportation may deem a Bus
Driver ineligible to work a trolley assignment for good cause.The Bus Driver
may file a written appeal to,the Director of Transportation with justification
for eligibility and the Director shall respond to the appeal in writing with their
determination within ten (10) calendar days from the date the Bus Driver
filed the appeal.
4. Trolley Equipment and Route Familiarization
a. Bus drivers who have never driven the Trolley route will be provided up to
1 hour of equipment and route familiarization training prior to the start of
their Trolley assignment. Compensation for the familiarization training will
be overtime pay at the applicable hourly rate.
5. Trolley driver uniform application and enforcement to be consistent with FAX
uniform policy that may also require the use of unique Trolley specific articles or
clothing as approved by the Director of Transportation.
6. Compensation for a trolley assignment shall be overtime pay at the applicable
hourly rate.
7. Hours Bus Drivers operate a trolley shall count towards driving time as defined in
Article VIII Section A.1.d. of the MOU between the City and ATU.
8. Trolley operations may be modified or cancelled for operational purposes at the
discretion of the Director of Transportation or designee and shall not adversely
impact fixed route service.
9. The parties agree to meet and confer on or after May, 7, 2024 for Phase II of Pilot
Program.
This agreement shall be in effect for one year from the commencement of service
beginning on the date below and expiring one calendar year from the effective date of this
agreement. The City reserves the right to discontinue the pilot program prior to the
expiration of this agreement with written notice to ATU or modify the operation of trolley
service following written notice to ATU on provisions within the mandatory scope of
bargaining under the Meyers-Milias-Brown Act ("MMBA") (Government Code § 3500 et
seq.).This agreement may be modified upon mutual agreement of the parties.
