SECOND AMENDMENT TO
AGREEMENT
THIS SECOND AMENDMENT TO AGREEMENT (Amendment) made and entered into
effective the 24th of July 2023, between the City of Fresno, a California municipal
corporation (City), and FCS International, Incorporated, a California corporation
(Consultant).
RECITALS
WHEREAS, the City and the Consultant entered into an agreement on
November 19, 2020 (Agreement), to provide professional environmental planning and
consulting services for the Southeast Development Area Specific Plan (SEDA); and
WHEREAS, City and Consultant entered into First Amendment, dated
December 27, 2022; and
WHEREAS, City and Consultant desire to extend the contract term to
December 31, 2023; and
WHEREAS, with entry into this Amendment, the Consultant agrees it has no claim,
demand, or dispute against the City.
AGREEMENT
NOW, THEREFORE, the parties agree that the aforesaid Agreement be amended
as follows:
1. The recitals to this Amendment are incorporated and made a part of this
Amendment.
2. The term of the Agreement shall be extended to December 31, 2023.
3. Except as otherwise provided herein, the Agreement entered into by the
City and the Consultant on November 19, 2020, and amended on December 27, 2022,
remain in full force and effect.
