SERVICE CONTRACT
This FIRST AMENDMENT TO SERVICE CONTRACT (First Amendment) made and
entered into as of this 15 day of � VP � 2023, amends the Service Contract entered
into between the CITY OF FRESNO, a California municipal corporation (City), and
PARTNERS IN CONTROL, INC., dba ENTERPRISE AUTOMATION, a California
corporation (Contractor).
RECITALS
WHEREAS, the City and the Contractor entered into a Service Contract on
June 26, 2023, for on -call SCADA system integration professional services and support
(Contract) for a price of $149,919; and
WHEREAS, the new centralized treatment facilities constructed at Pump Station 117
will require the development of complex programming for integration into the SCADA
system; and
WHEREAS, the City desires to increase the Contract price by $97,754 to complete
the services; and
WHEREAS, with entry into this First Amendment, the Contractor agrees it has no
claim, demand, or dispute against the City.
AGREEMENT
NOW, THEREFORE, the parties agree that the aforesaid Contract be amended as
follows:
1. The recitals to this First Amendment are incorporated and made a part of this
First Amendment.
2. Section 2 of the Contract is amended to read as follows:
"2. PRICE. For the monetary consideration of TWO HUNDRED FORTY-
SEVEN THOUSAND SIX HUNDRED SEVENTY-THREE DOLLARS AND ZERO
CENTS ($247 67. 3.00), Contractor promises and agrees to perform or cause to be
performed, in a good and workmanlike manner, and to the satisfaction of City, and in
strict accordance with the Specifications, all of the work as set forth in the Contract
Documents.
3. Except as otherwise provided herein, the Contract entered into by the City and
the Contractor on June 26, 2023, remains in full force and effect.
