THIS FIRST AMENDMENT TO AGREEMENT (Amendment) made and entered into as
of February 9, 2024, amends the Agreement entered into between the CITY OF
FRESNO, a municipal corporation, (City), and JSA INSPECTIONS & CONSULTING, a
California sole proprietorship (Consultant).
RECITALS
WHEREAS, the City and the Consultant entered into an agreement, dated February 9,
2023 (Agreement), for professional inspection and testing of potentially hazardous
materials (lead-based paint and asbestos-containing materials) as well as supervision of
removal of hazardous materials services for demolitions due to fire, inclement weather,
or other circumstance that renders a building hazardous to the neighborhood and any
persons entering the building (Project); and
WHEREAS, the City and the Consultant desire to exercise the 1-year option and extend
the Agreement to February 9, 2025, to continue the Project; and
WHEREAS, the Consultant agrees it has no claim, demands, or disputes against the City.
AGREEMENT
NOW, THEREFORE, the mutual promises herein conditioned, and for other good and
valuable consideration hereby acknowledge, the parties agree that the aforesaid
Agreement be amended as follows:
1. The recitals to this Amendment are incorporated and made a part of this
Amendment.
2. The Agreement is extended to February 9, 2025.
3. Except as otherwise provided herein, the Agreement entered into by the City and
the Consultant on February 9, 2023, remains in full force and effect.
