FIRST AMENDMENT TO AGREEMENT
THIS FIRST AMENDMENT TO GRANT AGREEMENT (Amendment) is effective as of
_________________, 2023, (the Effective Date) and amends the Grant Agreement for
small business assistance grants, small business eviction protection and mobile food
vendor business services between the City of Fresno, a California municipal corporation
(CITY), and Fresno Area Hispanic Foundation, a California Non-profit Corporation
(GRANTEE).
RECITALS
A. CITY and GRANTEE are parties to that certain Grant Agreement for small
business assistance grants, small business eviction protection and mobile food
vendor business services dated November 17, 2023 (the Agreement).
B. Pursuant to the Agreement, the CITY has issued to GRANTEE Program Funds in
relation to small business assistance grants, small business eviction protection and
mobile food vendor business services utilizing American Rescue Plan Act (ARPA)
funding.
C. CITY and GRANTEE now desire to extend the term of the Agreement in order to
complete the implementation of the program and expend all allocated funding.
AGREEMENT
NOW, THEREFORE, in consideration of the above recitals, which recitals are contractual
in nature, the mutual promises herein contained, and for other good and valuable
consideration hereby acknowledged, the parties agree that the aforesaid agreement be
amended to extend to June 4, 2024:
1. Term. The term of the Agreement expires on June 4, 2024.
2. Effect of Amendment. Except as expressly modified by this Amendment, the
Agreement is hereby reaffirmed and ratified. In the event of any conflict between
the Agreement and this Amendment, this Amendment shall control.
