HomeMy WebLinkAboutAmalgamated Transit Union, Local 1027 (ATU) Side Letter - Operation of Trolley Service-FAX 10/23/23Side Letter of Agreement Between City of Fresno and Amalgamated Transit Union, Local 1027 (A TU) Pilot Program for the Operation of Trolley Service in the Department of Transportation/FAX The City of Fresno ("City") and Amalgamated Transit Union, Local 1027 ("ATU"), collectively ("parties"), have met and conferred and agree to the below provisions regarding a pilot program for the operation of trolley service. 1.Operation of trolley service will be in conformance with Article IV.K., Bus Operation, of the MOU between the City and ATU. 2.Filling Trolley Assignments a.On the first day of each pay period, FAX will post three (3) Trolley Volunteer Lists ( one ( 1) each for Thursday, Friday, and Saturday trolley runs) whereby Bus Drivers may sign up through the end of the first workweek of the pay period (the first Monday through the first Sunday) to volunteer for a trolley assignment which provides service during the subsequent pay period. Trolley assignments shall be in addition to a Bus Driver's regularly scheduled workweek. b.Trolley assignments shall be filled by Bus Drivers who sign up on the respective Trolley Volunteer List for the day of the trolley assignment on a seniority basis. Seniority shall be defined as seniority in class based on length of continuous service as a permanent Bus Driver. After the most senior Bus Driver( s) on the list accepts a trolley assignment, declines a trolley assignment, or does not answer the department's attempt to contact the Bus Driver, the department will immediately proceed with contacting the next most senior Bus Driver(s) to fill trolley assignments. i.Bus Drivers who accept a trolley assignment are expected to work the assignment. ii.Bus Drivers who accept a trolley assignment and are unable to work their trolley assignment must notify the dispatcher by 10:00 a.m. the day prior to their scheduled trolley assignment. Failure to notify the dispatcher pursuant to this subsection may result in the Bus Driver being ineligible to sign up on any Trolley Assignment List for ninety (90)calendar days from the date of the scheduled trolley assignment. Side Letter of Agreement City and ATU Pilot Program: Operation of Trolley Service Page 2 of 3 7.Trolley operations may be modified or cancelled for operational purposes at the discretion of the Director of Transportation or designee, and shall not adversely impact fixed route service. 8.The parties agree to re-evaluate the terms of this agreement once the agreement has been in effect for ninety (90) calendar days. This agreement shall be in effect for one year from the commencement of service beginning on the date below and expiring one calendar year from the effective date of this agreement. The City reserves the right to discontinue the pilot program prior to the expiration of this agreement with written notice to ATU or modify the operation of trolley service following written notice to ATU on provisions within the mandatory scope of bargaining under the Meyers-Milias-Brown Act ("MMBA") (Government Code § 3500 et seq.). This agreement may be modified upon mutual agreement of the parties.
