FIRST AMENDMENT TO AGREEMENT
THIS FIRST AMENDMENT TO AGREEMENT (Amendment) made and entered
into as of this end day of May 20 23, amends the Agreement entered into
between the CITY OF FRESNO, a California municipal corporation (City), and
TEMPLE-ANDERSEN-MOORE ARCHITECTS, LLP, Inc, a California Corporation
(Consultant).
RECITALS
WHEREAS, City and Consultant entered into an Agreement dated November 16,
2022 for Architectural Services (Agreement); and
WHEREAS, the compensation under the Agreement was for a total of $14,500,
which included a contingency of an amount to not exceed $3,000 for additional work
rendered and authorized by the Director in writing; and
WHEREAS, the $3,000 contingency amount for additional work has not yet been
utilized: and
WHEREAS, Consultant has completed the ninety percent (90%) portion of the
Agreement; and
WHEREAS, City and Consultant now desire to modify the scope of work therein
pursuant to Section 3(c) of the Agreement to include additional services and
compensation; and
WHEREAS, City will utilize the $3,000 contingency funds in the Agreement, plus
an additional $2,000 for a total amount of $5,000 for additional services; and
WHEREAS, the combined amount for the Agreement and Amendment is $16,500.
AGREEMENT
NOW, THEREFORE, the parties agree that the
Agreement be amended as follows:
1. Consultant shall provide additional services as described in Attachment A,
attached hereto and incorporated herein by reference. Such additional services shall be
completed within 10 days following execution of this Amendment by both parties.
2. Consultant's sole compensation for satisfactory performance of all services
required or rendered pursuant to this Amendment shall be a total fee of $5,000; to be

comprised of the $3,000 contingency fund in the Agreement plus the $2,000 provided for
in this Amendment.
3. In the event of any conflict between the body of this Amendment and any
Exhibit or Attachment hereto, the terms and conditions of the body of this Amendment
shall control and take precedence over the terms and conditions expressed within the
Exhibit or Attachment. Furthermore, any terms or conditions contained within any Exhibit
or Attachment hereto which purport to modify the allocation of risk between the parties,
provided for within the body of this Amendment, shall be null and void.
4. Except as otherwise provided herein, the Agreement entered into by City
and Consultant, dated November 16, 2022, remains in full force and effect.

Overview:
Include an Option 2 Schematic Design as requested by the Assistant Director, Planning
& Development Department
Additional Scope of Services includes, but is not limited to:
Option 2 Schematic Design
Provide schematic layout of new office space on both first and second floor levels
First and second floor perspectives: provide multiple views of interior cubicles and offices
Provide preliminary estimate of probable construction costs and preliminary schedule for
construction
