THIS SECOND AMENDMENT TO AGREEMENT (Amendment) made and entered
into as of this _2L day of -- 202.R, amends the Agreement entered into
between the CITY OFF SNO, ACalifornia municipal corporation (City), and NORTH
COAST ENGINEERING, a California corporation (Consultant).
RECITALS
WHEREAS, the City and Consultant entered into an Agreement, dated November 19,
2020, for professional civil engineering services for design of plans and general construction
contract documents for Chestnut Avenue AC Overlay from Kings Canyon Road to Butler
Avenue, (Agreement); and
WHEREAS, Consultant has completed Part One and Part Two of the Agreement; and
WHEREAS, the City and Consultant amended the Agreement on August 27, 2021
(First Amendment) to provide additional cost for extended bond retention time; and
WHEREAS, the City and Consultant now desire to modify the scope of work, therein,
by requiring additional services; and
WHEREAS, due to the need for additional services, the parties desire to increase the
total compensation by an additional $2,080 to complete the expanded Scope of Services;
and
WHEREAS, with entry into this Amendment, Consultant agrees that it has no claim,
demands, or disputes against the City.
AGREEMENT
NOW, THEREFORE, the parties agree that the aforesaid Agreement be amended as
follows:
1. Consultant shall provide additional services as described in Attachment A,
attached hereto and incorporated herein by reference.
2. Consultant's sole compensation for satisfactory performance of all services
required or rendered pursuant to this Amendment shall be a total fee of $2,080.00.
3. In the event of any conflict between the body of this Amendment and any
exhibit or attachment hereto, the terms and conditions of the body of this Amendment shall
control and take precedence over the terms and conditions expressed within the exhibit or
attachment. Furthermore, any terms or conditions contained within any exhibit or
attachment hereto which purport to modify the allocation of risk between the parties,
provided for within the body of this Amendment, shall be null and void.
4. Except as otherwise provided herein, the Agreement and First Amendment
entered into by the City and Consultant, remain in full force and effect.

Consultant Service Second Amendment to Agreement between City of Fresno (City)
and North Coast Engineering (Consultant)
Chestnut Avenue AC Overlay from Kings Canyon Road to Butler Avenue
Consultant North Coast Engineering) shall perform the task described below in Item 1.
The consultant fee to provide additional design services is itemized as follows:
