FIRST AMENDMENT TO SERVICE CONTRACT
THIS FIRST AMENDMENT TO SERVICI; yONTRAC T (Amendment) made and
entered into as of this J/d day of Mlfy_ , 2022, amends the
contract entered into between the CITY OF FRESNO, a California municipal corporation
(City), and JOHNSON CONTROLS FIRE PROTECTION LP, (Contractor). The City and
the Contractor are collectively referred as the Parties in this Amendment.
RECITALS
WHEREAS, City and Contractor entered into a Service Contract (Contract) dated
February 1, 2022, in the amount of $612,200.00 for the Access Control project; and
WHEREAS, City and Contractor now desire to increase the Contract amount an
additional $164,821.00 for additional work to include the Animal Control Center and
various projects citywide and $61,200 for contingencies, for a total increase amount of
$226,041.00.
AMENDMENT
NOW, THEREFORE, the Parties hereby agree that the Contract is amended as
follows:
1. The Contract will be increased an additional $226,041.00 for a total
Contract amount of $838,241.
2. This Amendment shall become part of and subject to the terms and
conditions of the Contract, which except as modified herein, remains unchanged
and in full force and effect. However, to the extent that the terms and conditions
expressly set forth in this Amendment conflict with the terms and conditions of the
Contract and the Amendments, the terms and conditions expressly set forth in this
Amendment will prevail. Unless otheiwise defined in this Amendment, capitalized
terms used herein shall have the meanings assigned to such terms in the Contract.
By signing below, the undersigned certify that they have read and understand, and
agree to be legally bound by this Amendment.
