FRESNO, a municipal corporation, GRANTOR, hereby CITY of FRESNO, a municipal
corporation, GRANTEE, an easement and right-of-way for the benefit of public utilities and
for public utility purposes over, under, through, and across that Real Property situated in

Those portions of Lots 237 and 238 of J.C. Forkner Fig Gardens Subdivision No. 3,
according the map recorded in Volume 8 of Plats, at Page 79, Fresno County Records,
lying in Section 3, Township 13 South, Range 19 East, Mount Diablo Base and Meridian, in
the City of Fresno, County of Fresno, State of California, more particularly described as
follows:
Commencing at the Northwest corner of said Lot 237; thence South 0055'22" West, on the
West line of said Lot 237, a distance of 83.00 feet to the South line of the North 83.00 feet
of said Lot 237; thence North 89059'10" East, on said South line, a distance of 0.60 feet to
the southerly right of way line of West Herndon Avenue and being the POINT OF
BEGINNING; thence Continuing North 89059'10" East, on said right of way line, distance of
356.56 feet; thence South 0000'50" East, leaving said right of way line, a distance of 27.00
feet to a line parallel with and 110.00 southerly, at right angles with the North lines of said
Lots 237 and 238; thence South 89059'10"West, on said parallel line, a distance of 254.19
feet to the northeasterly right of way line of West Herndon Avenue and the beginning of a
non-tangent curve, concave southwesterly, having a radius of 1010.00 feet, at which point
a radial line bears North 17045'56" East; thence northwesterly on said curve, through a
