This upgrade will heavily offset our business usage and will be an environmentally sustainable feature. Community Location Our retail location is located at 703 N. Fulton, Fresno, 93728 in the South Tower area. Up until a few years ago, this area of the tower district was blighted but is seeing a resurgence of development and rehab of older buildings including the development of new apartment buildings like 541@ South Tower and the new Chevron/Johnny Quick Gas station at Van Ness and Belmont. The area still requires investment and work to beautify the area and fill vacant building storefronts. We hope to be a part of these great improvements and contribute to the areas beautification projects which will aide in bringing more people into the area to attract other businesses. We will be investing substantial funds to beautify and transform our building to conform to the vibe and feel of South Tower. 4 Youth Outreach and Education Green Treasure, Inc will also establish a public outreach and educational program for youth organizations and educational institutions that outlines the risks of youth use of cannabis, and that will identify resources available to youth related to drugs and drug addiction will be developed and ap proved by the city. Our plan to address the risks of youth use of cannabis and resources available to educate and help with drug addiction are as follows: o Work with local non-profits such as West Fresno Family Resource Center by providing financial donations to fund their anti-drug, marijuana outreach and education programs focused towards youth and families. o Identify local church youth groups available for help and other local organizations like P.A.I.N, a local non-profit that specializes in rehab and education services and place their information on our website We understand that edibles and vaping are the biggest concerns surrounding youth and cannabis currently. Our focus will be addressing these concerns and educating the youth on the harmful impacts to the development of young minds. FCRF Green Treasure, Inc. is open to contributing to the Fresno Community Reinvestment Fund as known as “The Fund” to help support the local cannabis equity businesses in attaining assistance with workforce development, access to commercial real estate, access to investment financing, access to legal services and admin support. Green Treasure, Inc is willing to consider and serve as a Social Equity Business Incubator by offering the following to those businesses who meet the requirements of the social equity program by providing executive mentorship, and training; in addition, we are committed to offering up to 20% shelf space dedicated to Fresno Equity Business products. Green Treasure, Inc. is local and wants to support local business as much as possible and help to expand those local brands through exposure to clients through our storefront and delivery service. 1 Neighborhood Compatibility Plan The safety and compatibility of Green Treasure, Inc. and its surrounding Fresno City neighbors is our top priority. Our company will adhere to Fresno’s laws and regulations regarding legal cannabis operations including the location site and retail operations. Emergency Contact The City Manager or his/her designee(s) will be provided an emergency contact person with the name, telephone number of an on -site employee or owner to whom emergency notice can be provided at any hour of the day . We will provide our neighbors with a community liaison to address our community members relations and will include • The name, telephone number, and email address of a community relations contact to whom notice of problems associated with the business can be provided. The information will be supplied to all businesses an d residences located within one hundred (100) feet of the commercial cannabis business. • The premises and its infrastructure will be continually maintained ; upkeep and operating characteristics is compatible with abutting properties and the surrounding neighborhood. • Green Treasure, Inc. will proactively do our due diligence in addressing potential concerns from our neighbors and maintaining our site so that it is visually attractive and not dangerous to the health, safety and general welfare of employees, patrons, surrounding properties, and the general public. The premises will not be maintained in a manner that causes a public or private nuisance Odor Control • Best available odor control technology and devices will be incorporated in a cannabis retail business and a commercial cannabis business to ensure that odors from cannabis are not detectable off -site. • A sufficient odor absorbing ventilation and exhaust sy stem will be provided so that odor generated inside the premises that is distinctive to its operation is not detected 2 outside of the facility, anywhere on adjacent property or public rights -of-way, on or about the exterior or interior common area walkways, hallways, breezeways, foyers, lobby areas, or any other areas available for use by common tenants or the visiting public, or within any other unit located inside the same building as the cannabis retail business or commercial cannabis business o Odor mitigation practices- techniques employed; prepackaged products , due to the immature (6” below) and teen plant (7” and above) will be packaged in containers during transportation and movements to reduce odor and due to the plant cycle? The odor is reduced until plant reaches flowering mature stage o An exhaust carbon air filtration system with odor control that prevents internal odors and pollen from being emitted externally; In addition, carbon filter scrubbing fans will be utilized to further reduce odors. An air system that creates negative air pressure between the premises' interior and exterior, so that the odors generated inside the premises are not detectable outside the premises. • Green Treasure Inc. plans to use some carbon filters attached to its HVAC exhaust fan as a proper ventilation system for dealing with cannabis-related odors and mitigating noxious fumes. The fully integrated and automated system will regularly call for the substitution of new filters, and therefore under no circumstances will there be any odor nuisance emitted from a Green Treasure, Inc. operations. • Carbon filters are considered the "gold standard" for controlling cannabis grow- room odors (also called 'carbon scrubbers') and will pull the smells out of the air, neutralizing any odors that pass through. Carbon filters neutralize the air coming out of the facility's exhaust, and a good carbon filter will make sure the facility never accidentally leaks the smell of cannabis out to the public. • These devices use activated carbon to chemically absorb smells and other impurities from any air that is pushed through the filter. The most common way to do this is to set up a carbon filter as a part of the exhaust system, which will have an exhaust fan pulling hot air away from the cultivation areas. As warm air is pulled out, and away from the facility, the carbon filter scrubs odors from the air on the way out. • Carbon filters are highly effective and extremely easy to maintain once they have been set up. Green Treasure Inc. will set up carbon filters in each area within the facility that contains cannabis, whether a living plant or cultivated product and will have an activated charcoal filter system connected to an inline fan with the proper CFM rating for the volume of the room. Each filter will continuously clean the air of odor particles and be replaced at least once per year, as prescribed by the automated system. All rooms containing live immature plants will be sealed, with no air entering or exiting, except when the door is opened for access by employees. • Weekly check for regular maintenance odor air filter. Daily odor checks to ensure odors are controlled. Staff will be trained in odor detection and weekly maintenance checks and filter checks. 3 Potential Sources of Odors • All cannabis products will arrive at our site prepackaged therefore reducing the odor being emitted • Sources may include the storage area for live plants and clones; which additional carbon filters will be employed; • Additional sources may include the samples a vailable for view on the retail sales floor; which additional carbon filters will be employed; Noise Control • Due to the nature of the business it is not anticipated that additional noise will be emitted beyond what is deemed typical of a retail operation • Hours of Operations end prior to the City of Fresno’s 10pm noise ordinance hours • Security will monitor disruptive noises and will eliminate sources • Any noise concerns and complaints will be investigated and addressed accordingly Light Control • Lighting will be controlled via timer system • Lighting will be limited to what is necessary to conduct business Litter Control • Litter will be routinely removed daily and through multiple points throughout the day on site • Additional trash containers will be available for customers to appropriately discard trash • Litter will be removed daily from the premises, including adjacent public sidewalks and all parking lots under the control of the cannabis retail business or commercial cannabis business; these areas will be swep t or cleaned, either mechanically or manually, on a weekly basis to control debris Vehicle Control • Vehicles will be prohibited from loitering in the area • Vehicles will be directed to and from premises as appropriate • All parking areas will be under security surveillance Pedestrian traffic • Security will monitor store patrons and ensure continual flow 4 • Loitering will be discouraged; Security will aide in prohibiting loitering by persons outside the facility both on the premises and within fifty (50) feet of the premises • Persons near the site will be under security surveillance • Pedestrians will be directed to maintain movement and flow either to or from the premises as appropriate Community Relations Liaison Green Treasure, Inc. will be available for our neighbors and will provide our contact information including our name, telephone number, and email address of a community relations contact to whom notice of problems associated with the business can be provided. Green Treasure, Inc. provide the above information to all businesses and residences located within one hundred (100) feet of our site. Waste Management Plan Green Treasure Inc. will implement a safe and compatible waste management plan in which fully meets the state requirements. Green Treasure Inc. will conduct due diligence to minimize overall cannabis waste. Cannabis waste is organic waste. Green Treasure, Inc. will manage cannabis waste generated on its licensed premises by: • On-premises composting of cannabis waste • Collection and processing of waste by local agency, waste hauler, or private waste hauler permitted • Self-haul cannabis waste to a fully manned permitted: solid waste landfill or transformation facility, composting facility/operation, in-vessel digestion facility/operation; transfer/processing facility/operation or permitted chip and grind operation/facility • Recycling center for cannabis waste that contains at least 90% inorganic material, the and that meets the following: inorganic portion of the cannabis waste is recycled into new, reused, or reconstituted products which meet the quality standards necessary to be used in the marketplace; and the organic portion of the cannabis waste will be sent to a facility/ operation to reintroduction of cannabis waste back into agricultural operation through on premises organic waste recycling methods, including but not limited to tilling directly into agricultural land and no-till farming. Acceptance Green Treasure will employ tactics to reduce our overall waste this includes accepting or rejecting, in whole, shipments of cannabis goods, however partial shipments of cannabis goods will be rejected in the following circumstances: • If a shipment containing cannabis goods that differ from those listed on the sales invoice or receipt, Green Treasure, Inc. will reject the portion of the shipment that is not accurately reflected on the sales invoice or receipt. 5 • If a shipment containing any cannabis goods that were damaged during transportation, Green Treasure, Inc. will reject that portion of the shipment that was damaged • If a shipment containing cannabis goods that is non-compliant with Bureau of Cannabis Control Order of Adoption labeling requirements or exceeds its provided expiration date, Green Treasure, Inc. will reject the portion of the shipment that is non-compliant with labeling requirements or expired. • Any rejected shipment of cannabis goods, whether in whole or in part, will be recorded in the track and trace system, and indicated on any relevant manifest, invoice, or sales receipt, the specific reason for rejection. Returns If Green Treasure, Inc. discovers that a manufactured cannabis good that was purchased from another licensee is defective, Green Treasure, Inc. may return the manufactured cannabis good to the selling licensee only in exchange for a non-defective version of the same type of manufactured cannabis good or in exchange for a manufactured cannabis good of equal value. Destruction of Cannabis Goods Prior to Disposal Cannabis waste will be stored, managed, and disposed of in accordance with all applicable waste management laws, including, but not limited to, Division 30 of the Public Resources Code. Cannabis goods intended for disposal will remain on the licensed premises until rendered into cannabis waste. Green Treasure, Inc. will ensure that: • Access to the cannabis goods is restricted to the licensee, its employees or agents • Storage of the cannabis goods allocated for disposal is separate and distinct from other cannabis goods • To be rendered as cannabis waste for proper disposal, including disposal as defined under Public Resources Code section 40192, cannabis goods shall first be destroyed on the licensed premises o This includes, at a minimum, removing or separating the cannabis goods from any packaging or container and rendering it unrecognizable and unusable o Cannabis waste on premises will be secured in a receptacle or area that is restricted to the licensee, its employees, or an authorized waste hauler o A licensee shall report all cannabis waste activities, up to and including disposal, into the track and trace system • An original copy of the commercial cannabis business permit issued by the city and the city issued business license will be posted inside the cannabi s retail business or a commercial cannabis business in a location readily visible to the public Zoning Inquiry P20-03919 703 North Fulton Street, Suite 101 Page 2 November 17, 2020 The subject property is not located within 800 feet of the property boundary of any of the above-mentioned uses. The subject building meets the separation requirements, per Section 15-2739.B.1.b of the FMC, for a cannabis retail business. 3. Prior to commencing operations, a cannabis retail business must obtain a Cannabis Conditional Use Permit from the Planning and Development Department per Section 15- 2739.N of the FMC. 4. No more than 2 cannabis retail businesses may be located in any one Council District. If more than 14 are ever authorized by Council (more than 2 per Council District), they shall be dispersed evenly by Council District. The subject property is in Council District 3. There are currently no cannabis retail businesses located in Council District 3. This location requirement is satisfied for a cannabis retail business. Please review the entirety of Article 33, Chapter 9 (Cannabis Retail Business and Commercial Cannabis), and Section 15-2739 (Adult Use and Medicinal Cannabis Retail Business and Commercial Cannabis Business) of the FMC to understand other requirements of cannabis retail businesses, including but not limited to, application requirements, signage, etc. This information was researched by the undersigned per the zoning request.
