CITY OF FRESNO
MEMORANDUM OF UNDERSTANDING BETWEEN
FRESNO POLTCE DEPARTMENT ("FPD') AND
FRESNO FIRE DEPARTMENT ("FFD")
The City of Fresno's ("C|TY") FRESNO POLICE DEPARTMENT
("FPD") and FRESNO FIRE DEPARTMENT ("FFD') enter into this
Memorandum of Understanding ("MOU") to work in partnership to secure and maintain
access to a radio tower located in the Southeast section of the City, located at (4607 E
Vine, Fresno, CA, 93725).
WHEREAS, FPD and FFD recognize the importance of radio communications for
facilitating the work of agency first responders; and
WHEREAS, FPD and FFD desire to enter into this MOU to apportion costs and
responsibilities related to a radio tower.
NOW, THEREFORE, in consideration of the foregoing and for other good and
valuable consideration it is hereby agreed by FPD and FFD as follows:
1. FPD and FFD anticipate that the operation and maintenance of the radio
tower will be accomplished through a fifteen-year shared lease agreement
between American Tower Corporation and both agencies.
2. Each department will pay respective costs through their departmental
budgets.
3. FPD and FFD will each pay fifty percent (50%) of the lease and
associated recurring costs for the duration of the lease.
4. Each department will be responsible for one hundred percent (100%) of
equipment costs benefitting only that department (i.e. transmitters,
receivers, antenna benefitting only FPD or FFD).
5. Any other costs benefitting FPD and FFD evenly will be divided evenly so
that each department pays fifty percent of shared costs (i.e. equipment
installation costs).
6. Either hereto may terminate this MOU upon 90 days'written notice to
the other party and approval by the City Manager.
7. The term of this MOU shall be the term of the lease with American Tower
Corporation, subject to renewal by the parties.
8. Any disputes or controversies arising hereunder shall be referred to
and resolved by the City Manager or designees thereof.

California, the day and year first above written.
