AMENDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT (Amendment) made and entered into as of this
_6_ day of _November_, 2020, amends the Agreement entered into between the CITY
OF FRESNO, a municipal corporation (City), and Fresno Economic Opportunity
Commission (FEOC) (Subrecipient). City and Subrecipient are collectively referred to as
Parties.
RECITALS
WHEREAS, City and Subrecipient entered into an Agreement, dated November
22, 2019, for the use of Program Year 2019 Community Development Block Grant
(CDBG) funds for the Fresno Street Saints Program to operate afterschool and
recreation programs serving the youth (Agreement); and
WHEREAS, City and Subrecipient desire to further extend the term of the
Agreement.
AGREEMENT
NOW, THEREFORE, in consideration of the above recitals, which recitals are
contractual in nature, the mutual premises herein contained, and for other good and
valuable consideration hereby acknowledge, the Parties agree that the aforesaid
Agreement be amended as follows:
1. The term of the Agreement is extended to December 31, 2020, with the
commencement of the period of performance remaining October 1, 2019.
2. In the event of any conflict between the body of this Amendment and any
Exhibit or Attachment hereto, the terms and conditions of the body of this Amendment
shall control and take precedence over the terms and conditions expressed within the
Exhibit or Attachment. Furthermore, any terms or conditions contained within any
Exhibit or Attachment hereto which purport to modify the allocation of risk between the
Parties, provided for within the body of this Amendment, shall be null and void.
3. Except as otherwise provided herein, the Agreement entered into by City
and Subrecipient, dated November 22, 2019, remains in full force and effect.
