THE CITY OF FRESNO AND ASIAN BUSINESS INSTITUTE & RESOURCE CENTER
REGARDING SMALL BUSINESS RELIEF
THIS GRANT AGREEMENT (AGREEMENT) is made and entered into effective
upon execution by both parties (the Effective Date), by and between the CITY OF
FRESNO (the CITY), and ASIAN BUSINESS INSTITUTE & RESOURCE CENTER
(GRANTEE), to provide funding for outreach, education, and assistance to small
Southeast Asian businesses within the Southeast, Central, and Southwest area of the
City of Fresno.
RECITALS
WHEREAS, small businesses are suffering as a result of business closures and
a reduction in services as a result of the COVID-19 outbreak; and
WHEREAS, the City has programs and protocols in place to assist businesses,
both by way of small business grants and public health and safety guidelines; and
WHEREAS, GRANTEE proposes to provide outreach, education, and assistance
to small Southeast Asian businesses within the Southeast, Central, and Southwest area
of the City of Fresno to help connect small businesses with the resources the City has
available; and
WHEREAS, this program is a necessary expenditure occasioned by the COVID-
19 public health emergency, not accounted for in the City's budget as of March 27,
2020; and
WHEREAS, GRANTEE represents it desires to and is professionally and legally
capable of immediately implementing the outreach and education program; and
WHEREAS, GRANTEE acknowledges that grant funds being provided under this
Agreement will be derived from the City's Coronavirus Relief Fund allocation under the
federal CARES Act (42 U.S.C. 801 et seq.) and subject to the constraints set forth in the
CARES Act; and
WHEREAS, this Agreement will be administered for the City by its City Manager
or its designee.
AGREEMENT
NOW, THEREFORE, in consideration of the foregoing and of the covenants,
conditions, and premises hereinafter contained to be kept and performed by the
respective parties, it is mutually agreed as follows:
1.Scope of Services. GRANTEE shall perform to the satisfaction of the
CITY the services described in Exhibit A, including all work incidental to, or necessary
to perform, such services even though not specifically described in Exhibit A.
2.Grant Amount. City shall provide GRANTEE the amount of $130,650 for
the services described in Exhibit A, payable in two installments. The first installment of
50% of the Grant Amount shall be payable on the Effective Date. The second
installment shall be paid no sooner than 45 days from the effective date. The amount of
