A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA, AUTHORIZING THE PURCHASE OF TWO (2) SEMI-
PORTABLE LIQUID NATURAL GAS FUEL STATIONS WITHOUT
ADVERTISED COMPETITIVE BIDDING
WHEREAS, the City of Fresno requires the purchase of a Liquid Natural Gas
(LNG) fueling station to provide LNG fuel for City-owned refuse trucks and other heavy
duty vehicles; and
WHEREAS, the LNG fueling station needs to be semi-portable in design to
provide for expedient installation, low cost future relocation, and full fueling capability
for City-owned refuse trucks and other heavy duty vehicles; and
WHEREAS, for portability (including ease of transport and installation), the
design of the City-owned LNG station needs to include construction of a unit (equipped
with submerged pump, dispenser, vaporization coils, 6000 gallon capacity storage tank,
vacuum insulated piping, and electrical/control/alarm panels) in a Department of
Transportation approved inter-modal shipping container; and
WHEREAS, after investigation by the Fleet Division and review by the
Purchasing Manager, it has been determined that only Model IMC 6000 meets all such
requirements and is available only from Nexgen Fueling Inc; and
WHEREAS, the Purchasing Manager represents that the cost of two Model IMC
6000, including sales tax and freight will not exceed $629,807.20; and
WHEREAS, City of Fresno Municipal Code Section 3-105 requires advertised
competitive bidding for equipment involving the expenditure of City monies in excess of
$51,000, unless Council determines that the work to be done or the goods to be
supplied can only be provided by one source, and the purchase is authorized by
resolution of the Council containing a declaration of the facts constituting the sole
source.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as
follows:
a. The Council has received and considered the report and
recommendations of City staff.
b. The purchase of two Model IMC 6000 is necessary, because it is the only
LNG fueling station meeting City's need that the station be semi-portable.
C. Model IMC 6000 is only available from a single source, Nexgen

d. Advertised competitive bidding for two Model IMC 6000, is suspended
under the sole source exception.
e. The Purchasing Manager is authorized to enter into a contract for the
purchase of two Model IMC 6000 containerized, semi-portable, LNG
fueling stations from Nexgen Fueling Inc., at a total cost, including sales
tax and freight, not to exceed $629,807.20, which is the amount of the
funds appropriated for this purchase.
