HomeMy WebLinkAboutResolution - - 2003-246 - 7/29/2003 RESOLUTION NO. 2003-246 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, ESTABLISHING PUBLIC BENEFIT FINDINGS AND APPROVING THE ACQUISITION OF PROPERTY LOCATED AT THE SOUTHEAST CORNER OF SOUTH MARKS AND WEST CALIFORNIA AVENUES TO CONVEY TO THE STATE OF CALIFORNIA FOR THE DEVELOPMENT OF A HOME FOR AMERICAN MILITARY VETERANS WHEREAS, the State of California (State) is seeking to acquire a site to develop a Veterans Home (Home) in Fresno County; and WHEREAS, the State has reviewed eight sites and selected a site on the southeast corner of South Marks and West California adjacent to the proposed Running Horse development as the preferred site (Site) (attached Exhibit 1); and WHEREAS, The State requires the land be donated with a commitment to provide utilities; and WHEREAS, local veterans have requested that the City acquire the Site and convey it to the State; and WHEREAS, the construction and operation of the Site will provide substantial public benefits in the form of job creation, enhanced sales tax revenue and stimulus for further economic development in Southwest Fresno all as quantified in the attached July 29, 2003 Staff Report and related exhibits. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows: -- 1. The Council finds that the public benefits associated with the construction and operation of the Home, including job creation, increased sales tax revenue and stimulus for further Southwest Fresno economic development justify the total payment of $756,250 (an additional $247, 500 over and above the City appraisal)to acquire the Site. 2. The Council approves the acquisition of the Site and authorizes the City Manager to execute a purchase and sale agreement on the terms set forth in his July 24, 2003 Letter of Intent. 3. The Site purchase will be accomplished through an escrow account which will be opened immediately upon adoption of this resolution. The terms of the escrow will include the completion of all necessary actions under the California Environmental Nw oWwd �� � Quality Act and annexation of the Site to the City along with standard escrow instructions.
