A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, CALIFORNIA, AUTHORIZING THE EXECUTION
OF CERTIFICATIONS AND ASSURANCES, AND THE
ANNUAL FILING OF APPLICATIONS FOR, ACCEPTANCE
OF, AND EXECUTION OF ALL DOCUMENTS AND
INSTRUMENTS RELATED TO STATE TRANSPORTATION
ASSISTANCE AUTHORIZED AND ADMINISTERED BY
THE CALIFORNIA OFFICE OF EMERGENCY SERVICES
(Cal OES), THE CALIFORNIA STATE TRANSPORTATION
AGENCY (CaISTA), OR THE CALIFORNIA DEPARTMENT
OF TRANSPORTATION (Caltrans)
WHEREAS, the statutes related to state-funded transit projects require a local
or regional implementing agency to execute an agreement with Cal OES, CaISTA, or
Caltrans before it can be reimbursed for project expenditures; and
WHEREAS, the Cal OES, CaISTA, and Caltrans utilizes agreements or Master
Agreements for State-Funded Transit Projects, along with associated Program
Supplements, for the purpose of administering and reimbursing state transit funds to
local agencies; and
WHEREAS, the City of Fresno desires to seek grant funds made available
through programs such as the Highway Safety, Traffic Reduction, Air Quality, and Port
Security Bond Act of 2006 (Proposition 113), Low Carbon Transit Operations Program
(LCTOP), Transit and Intercity Rail Capital Program (TIRCP), and future state funding
programs to fund public transportation/transit projects.
NOW, THEREFORE, BE IT RESOLVED BY the Council of the City of Fresno
as follows:

1. The City approves the application for and acceptance of grant fundin

from Cal OES for projects and participation therein, consistent with constitutional and
local law requirements and this resolution.
2. The City approves the application for and acceptance of grant funding
from CaISTA for projects and participation therein, consistent with constitutional and
local law requirements and this resolution.
3. The City approves the application for and acceptance of grant funding
from Caltrans for projects and participation therein, consistent with constitutional and
local law requirements and this resolution.
4. The City certifies that the City has reviewed, understands and, to the
extent consistent with all constitutional and local law requirements and this resolution,
agrees to the provisions contained in the program guidelines, and related documents.
5. The City of Fresno is a public entity established under the laws of the
State of California, and a Designated Recipient as defined by Senate Bill 88 (SB88)
and Government Code Section (8879.55).
6. The City Manager, Director of Transportation, or their designee is
authorized to prepare and execute for and on behalf of the City of Fresno, any actions
necessary, all documents including, but not limited to applications, agreements,
amendments, certifications and assurances, and payment requests which are
necessary to the purpose of obtaining grant funds provided by Cal OES, CaISTA, and
Caltrans.

At the Council meeting of 7/20/17, Council adopted the attached Resolution No. 2017-189,
entitled Authorizing the application for and execution of documents related to the Low
Carbon Tranasit Operations Program Project: Operating Support FAX Extended Night
Service. 112, ID#17-912, by the following vote:

Please indicate either your formal approval or veto by completing the following sections and
executing and dating your action. Please file the completed memo with the Clerk's office on
or before July 31, 2017. In computing the ten day period required by Charter, the first day
has been excluded and the tenth day has been included unless the 10th day is a Saturday,
Sunday, or holiday, in which case it has also been excluded. Failure to file this memo with
the Clerk's office within the required time limit shall constitute approval of the ordinance,
resolution or action, and it shall take effect without the Mayor's signed approval.
