A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA, AUTHORIZING THE PUBLIC WORKS DIRECTOR OR
HIS DESIGNEE TO SIGN AN AGREEMENT WITH THE FRESNO
METROPOLITAN FLOOD CONTROL DISTRICT
WHEREAS, the City of Fresno ("City") and the Fresno Metropolitan Flood
Control District ("District") wish to enter into an agreement which will facilitate a
$41,039.43 payment to the City by the District; and
WHEREAS, the City reconstructed neighborhood street improvements as
a part of the City's Hidalgo Elementary School Neighborhood Improvement Project,
Phase II; and
WHEREAS, the City designed and constructed street improvements including
storm drain inlets and mow strip and fence at the Districts' Basin II -4, located on the
north side of E. Thomas Avenue between N. Millbrook Avenue and N. Eighth Street as
a part of the project; and
WHEREAS, the City desires to transfer ownership of the Basin II -4 fence and
mow strip to the District for perpetual operation and maintenance; and
WHEREAS, the City will retain ownership of the street improvements with the
street right of way.
NOW, THEREFORE, IT IS RESOLVED BY THE COUNCIL OF THE CITY OF
FRESNO AS FOLLOWS:
1. The City Council of the City of Fresno, does hereby authorize the Public
Works Director or his designee to sign the agreement with the District.
2. The City Council directs staff to deposit the $41,039.43 payment into the
Proposition No. 111 Special Gas Tax Fund.
