A RESOLUTION ESTABLISHING DISADVANTAGED
BUSINESS ENTERPRISE (DBE) PROGRAM GOALS FOR
2005-2006 IN U.S. DEPARTMENT OF TRANSPORTATION
(DOT) ASSISTED PROJECTS/CONTRACTS FOR THE
FEDERAL HIGHWAY ADMINISTRATION (FHWA), FEDERAL
AVIATION ADMINISTRATION (FAA), AND FEDERAL
TRANSIT ADMINISTRATION (FTA)
WHEREAS, as a public employer, the City of Fresno recognizes that it has a particular
responsibility to promote the growth of Disadvantaged Business Enterprises (DBEs); and
WHEREAS, the City of Fresno is a recipient of federal financial assistance from the
U.S. Department of Transportation (DOT) agencies, Federal Highway Administration
(FHWA), Federal Aviation Administration (FAA), and Federal Transit Administration (FTA)
and as a condition to receiving such assistance is required to comply with 49 CFR, Parts 23
and 26 including implementation of a DBE Program; and
WHEREAS, 49 CFR Parts 23 and 26 and the Program require that the City annually
establish goals for DBE participation in U.S. Department of Transportation (DOT) assisted
projects/contracts for Federal Highway Administration (FHWA), Federal Aviation
Administration (FAA), and Federal Transit Administration (FTA) for incorporation into the
Program.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows:
Establishment of 2005-2006 Annual Goals. The Council hereby
establishes the following goals of ten percent (10%) each for Disadvantaged Business
Enterprise (DBE) participation in U.S. Department of Transportation (DOT) assisted
projects/contracts for the Federal Highway Administration (FHWA), Federal Aviation

Administration (FAA), and Federal Transit Administration (FTA) for 2005-2006. The City

estimates that race -neutral means will achieve 2% of the 10% goal for each agency. The
balance of 8% of the 10% goals of each agency will be achieved by race -conscious
measures.
The methodology for establishing the Annual DBE Goals is set forth in the
Program. The DBE annual goals for the Federal Highway Administration (FHWA), Federal
Aviation Administration (FAA), and Federal Transit Administration (FTA) established
hereunder shall become effective October 1, 2005, and shall continue until September 30,
2006.
2. Authority of DBE Liaison Officer. The DBE Liaison Officer, with the approval
of the City Manager, is hereby authorized to amend the Program to the extent required by any
amendment of the Code of Federal Regulations modifying DBE Program requirements, which
amendment shall become part of the City's DBE Program.
