RESOLUTION NO. 2005-84

A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA,
AMENDING THE 2025 FRESNO GENERAL PLAN AND THE BULLARD
COMMUNITY PLAN (PLAN AMENDMENT APPLICATION NO. A-04-26)
WHEREAS, on November 19, 2002, by Resolution No. 2002-379, the City Council adopted
the 2025 Fresno General Plan which correspondingly updated the Bullard Community Plan and by
Resolution No. 2002-378 certified Master Environmental Impact Report No. 10130 which evaluated
the potentially significant adverse environmental impacts of urban development within the City of
Fresno's designated urban boundary line and extended sphere of influence; and,
WHEREAS, The John Allen Company and WCM Land have filed an application proposing to
amend the aforementioned plans from the medium high density residential planned land use
designation to the medium density residential planned land use designation for 10 acres; the
community commercial planned land use designation to the medium density residential planned land
use designation for 12 acres; and the medium high density residential planned land use designation
to the community commercial planned land use designation for 11 acres, as shown on the attached
Exhibit A. The plan amendment application also proposes to delete Gates Avenue between North
Figarden Drive and West Bullard Avenue and West Bullard Avenue between North Brunswick and
North Bulletin Avenues from the circulation element of the 2025 Fresno General Plan and repeal the
official plan lines for these streets; and,
WHEREAS, the environmental assessment conducted for the proposed plan amendment
resulted in the filing of a mitigated negative declaration; and,
WHEREAS, on December 13, 2004, the Bullard Community Plan Advisory Committee
recommended approval of the proposed plan amendment application; and,
WHEREAS, on February 9, 2005, the Fresno City Planning Commission held a public hearing
to consider Plan Amendment Application No. A-04-26 and associated mitigated negative declaration
for Environmental Assessment No. A-04-26/R-04-84/C-04-272/T-5433; and,

WHEREAS, the Planning Commission took action to recommend approval of the mitigated
negative declaration for Environmental Assessment No. A-04-26/R-04-84/C-04-272/T-5433 dated
January 19, 2005; and,
WHEREAS, the Fresno City Planning Commission also took action, as evidenced in Planning
Commission Resolution No. 12161, to recommend approval of Plan Amendment Application
No. A-04-26, which would amend the planned land use designations for the subject sites from the
community commercial and medium-high density residential planned land use designations to the
community commercial and medium density residential planned land use designations and to
approve the applicant's request to delete Gates Avenue between North Figarden Drive and West
Bullard Avenue and West Bullard Avenue between North Brunswick and North Bulletin Avenues from
the circulation element of the 2025 Fresno General Plan and repeal the official plan lines for these
streets; and,
WHEREAS, on March 1, 2005, the Fresno City Council held a public hearing to consider Plan
Amendment Application No. A-04-26 and received both oral testimony and written information
presented at the hearing regarding Plan Amendment Application No. A-04-26.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno, based upon the
testimony and information presented at the hearing and upon review and consideration of the
environmental documentation provided, as follows:
1. The Council finds that there is no substantial evidence in the record that Plan
Amendment Application No. A-04-26 may have a significant effect on the environment
and hereby adopts the mitigated negative declaration dated January 19, 2005.
2. The Council finds the adoption of the proposed plan amendment as proposed by the
applicant is in the best interest of the City of Fresno.
3. The Council of the City of Fresno hereby adopts Plan Amendment Application
No. A-04-26 amending the 2025 Fresno General Plan and Bullard Community Plan the
aforementioned plans from the medium high density residential planned land use
designation to the medium density residential planned land use designation for 10
acres; the community commercial planned land use designation to the medium density
residential planned land use designation for 12 acres; and the medium high density
residential planned land use designation to the community commercial planned land
use designation for 11 acres, as shown on the attached Exhibit A. The 2025 Fresno
General Plan will also be amended to delete Gates Avenue between North Figarden
Drive and West Bullard Avenue and West Bullard Avenue between North Brunswick
and North Bulletin Avenues from the circulation element of the 2025 Fresno General
Plan and repeal the official plan lines for these streets.
