RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO
(1) APPROVING COOPERATIVE AGREEMENT NO. 06 -1268 WITH
THE STATE DEPARTMENT OF TRANSPORTATION FOR FREEWAY
180 WEST FROM MARKS AVENUE TO THE HUGHES/WEST
DIAGONAL AND (2) AUTHORIZING THE PUBLIC WORKS DIRECTOR
OR HIS DESIGNEE TO SIGN THE AGREEMENT ON BEHALF OF THE
CITY OF FRESNO
WHEREAS, the State and City, pursuant to Streets and Highways Code Section
73 and 130, are authorized to enter into a Cooperative Agreement in order to relinquish
to the City, a portion of existing State Route 180 and support facilities within the City of
Fresno; and
WHEREAS, the State is contemplating a project to realign State Route 180 from
South Brawley Avenue to the Hughes/West Diagonal; and
WHEREAS, as part of the State's realignment work, the State desires to
relinquish to the City that portion of State Route 180 (Whites Bridge Road) from South
Marks Avenue to the Hughes/West Diagonal (see attached Exhibit A), including newly
constructed "collateral facilities" (see attached Exhibit B); and
WHEREAS, the State and City have negotiated an understanding that, while
State will continue to maintain that part of State Route 180 in a "state of good repair"
until the date of relinquishment by the California Transportation Commission, the City,
for specific improvements to be constructed as part of States project in the form of
pavement rehabilitation as determined by an engineering study approved by both City
and State, will accept the relinquishment of this described portion of State Route 180;
and
WHEREAS, the relinquishment to the City will occur upon approval by the
California Transportation Commission of a Resolution of Relinquishment and the
recording of said resolution in the Fresno County Recorder's Office.
NOW, THEREFORE , IT IS RESOLVED BY THE COUNCIL OF THE CITY OF
FRESNO AS FOLLOWS:
1. The City Council approves Cooperative Agreement No. 06 -1268 with the
State Department of Transportation for Freeway 180 West from Marks
Avenue to the Hughes/West Diagonal
2. The City Council authorizes the Public Works Director or his designee to
sign State Cooperative Agreement No. 06 -1268

executing and dating your action. Please file the completed memo with the Clerk's office on

been excluded and the tenth day has been included unless the 10th day is a Saturday,
Sunday, or holiday, in which case it has also been excluded. Failure to file this memo with
the Clerk's office within the required time limit shall constitute approval of the ordinance,
resolution or action, and it shall take effect without the Mayor's signed approval.
