RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA AUTHORIZING AN APPLICATION TO THE
DEPARTMENT OF THE INTERIOR, BUREAU OF RECLAMATION
FOR AN FY 2011 WATERSMART: WATER AND ENERGY
EFFICIENCY GRANT IN THE AMOUNT OF $290,198 FOR THE
NIELSEN RECHARGE BASIN PROJECT AND EXECUTION OF
ALL APPLICATION DOCUMENTS ON BEHALF OF THE CITY
WHEREAS, the City of Fresno retains a current contract with the Department of
Interior, Bureau of Reclamation ("Bureau of Reclamation"), Contract No. 14-06-200-
890 ID, for water service from the Friant Division; and
WHEREAS, the Bureau of Reclamation has issued a Notice of Funding
Availability ("NOFA") under the WaterSMART: Water and Energy Efficiency Grants for
Fiscal Year (FY) 2011; and
WHEREAS, the Fresno Metropolitan Water Resource Management Plan calls for
reducing the use of groundwater, using direct surface water treatment for potable
consumption and the implementation of recharge systems to offset the current condition
of overdraft and to reach groundwater equilibrium by 2025; and
WHEREAS, the Nielsen Recharge Basin Project ("Project") will provide
groundwater recharge, improve the efficient use of existing surface water supplies, and is
consistent with the objectives of the Fresno Metropolitan Water Resource Management
Plan; and
WHEREAS, the City of Fresno's capital improvement plan anticipates the
purchase and construction of additional recharge facilities and funds those projects
through the Water Enterprise Fund, and upon acceptance of the grant the City will have
the full capability to provide the amount of funding and/or in-kind contributions specified
in the funding plan; and
WHEREAS, the City of Fresno Department of Public Utilities is desirous of
submitting a WaterSMART Grant application to fund said Project.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as
follows:
1. The Council of the City of Fresno authorizes the submittal of an application to the
Bureau of Reclamation for a WaterSMART: Water and Energy Efficiency Grant for FY
2011 in the amount of $290,198 for the Project, provided that the City of Fresno shall not
be bound under the application, nor shall the City of Fresno accept or be deemed to have
accepted the WaterSMART grant referenced in the application, unless and until the City
spud -
Council approves the terms and conditions of such grant, consistent with the program
requirements and all Constitutional and local law requirements, which terms and
conditions shall be contained in a written agreement prior approved as to form by the
Office of the City Attorney.
2. The City of Fresno Public Utilities Director and designee(s) thereof and each of
them as agents of the City of Fresno are authorized and directed to prepare, execute and
submit application documents and materials.
3. The Nielsen Recharge Basin Project is being submitted as a Group i project which
awards up to $300,000 and the City of Fresno, upon acceptance of the grant, will be
prepared to fund 50% or more of the Project.
4. The City Attorney is authorized to execute program related certifications,
assurances and opinions.
5. Subject to the foregoing provisions, the City certifies it has legal authority to
submit a program application to the Bureau of Reclamation.
6. Nothing in this resolution binds or obligates that City's general fund, taxing
authority, or borrowing capacity.
