HomeMy WebLinkAboutResolution - - 2017-096 - 4/6/2017 0 F rR? n �''l?'i•i3` n �r�A 4G:-ti'l RESOLUTION NO. 2017-96 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, AUTHORIZING SUBMITTAL OF AN FINAL APPLICATION TO THE STATE WATER RESOURCES CONTROL BOARD FOR A GROUNDWATER SUSTAINABILITY GRANT PROGRAM FOR FUNDING RELATED TO PLANNING, MONITORING AND IMPLEMENTATION PROJECTS FOR MITIGATION OF 1,2,3-TRICHLOROPROPANE FROM GROUNDWATER WELLS LOCATED THROUGHOUT THE CITY OF FRESNO IN THE AMOUNT OF $1,000,000 AND AUTHORIZING THE EXECUTION OF DOCUMENTS WHEREAS, during 2014, the State Water Resources Control Board (SWRCB) adopted and has the responsibility for the administration of the Groundwater Sustainability Grant Program which is identified in the California Water Code section 79706 (a) et. seq., which establishes the necessary guidelines for grants, loans, for projects that prevent or cleanup the contamination of groundwater that serves as a drinking water source, and WHEREAS, the City is desirous of submitting an application to fund said projects, and WHEREAS, the SWRCB requires that the governing body of the applicant submit a resolution designating an authorized representative or his designee to execute the loan application to the State. NOW, THEREFORE, BE IT RESOLVED BY THE Council of the City of Fresno as follows: 1. The Council of the City of Fresno, California, authorizes the submittal of applications to the SWRCB for the Groundwater Sustainability Grant Program for a 1 of 3 Date Adopted: 04/06/2017 Date Approved. 04/06/2017 Effective Date: 04/06/2017 Resolution No. 2017-96 L[� OF r, pro cc • r-r`y`t'�a a 4 grant in the amount of $1,000,000 for Planning, Monitoring and Implementation project activities of the City's Groundwater Wells, provided that: (i) the City shall not be bound under the applications, nor shall City accept or be deemed to have accepted the Groundwater Sustainability Grant Program referenced in the application, absent City Council approval of grant terms and conditions that are consistent with Groundwater Sustainability Grant Program requirements and all constitutional and local law requirements, which terms and conditions shall be contained in written contract prior to approval as to form by the Office of the City Attorney, (ii) the applications do not and shall not be deemed to constitute a certification or opinion by the Office of City Attorney as to any matter embraced therein, (iii) the City's legal authority, liability and obligation under any program grant agreement is subject to constitutional and local law requirements, this resolution and pledged, segregated revenue sources identified and appropriated under the agreement. 2. The City DPU Director designee(s) thereof are authorized and empowered to execute the application in the name of the City. 3. The Office of the City Attorney is authorized to execute program related certifications, assurances and opinions. 4. Please file the completed memo with the Clerk's office on or before April 17, 2017. In computing the ten day period required by Charter, the first day has been excluded and the tenth day has been included unless the 101" day is a Saturday, Sunday, or holiday, in which case it has also been excluded. Failure to file this memo with the Clerk's office within the required time limit shall constitute approval of the ordinance, resolution or action, and it shall take effect without the Mayor's signed approval.
