Resolution No. 93-256 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, IN THE MATTER OF THE TENTATIVE CANCELLATION OF AGRICULTURAL LAND CONSERVATION CONTRACT 717. WHEREAS, Agricultural Land Conservation (ALCC) No. 717 between the County of Fresno and Yoshiji Sugahara recorded on February 28, 1969; and WHEREAS, the City of Fresno succeeded to ALCC No. 717 at the time the subject territory was annexed in 1981; and WHEREAS, the owner of the subject territory (Yoshiji Sugahara) has requested cancellation of said ALCC Contract No. 717; and WHEREAS, in accordance with Section 51283(b) of the Government Code, the County Assessor certified the cancellation valuation to this Council for determination of the cancellation fee; and WHEREAS, this Council has determined the cancellation fee to be in the amount of $137,500; and WHEREAS, the Fresno City Council finds this cancellation of said Contract ALCC No. 717 to be consistent with the purpose of the Williamson Act. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Fresno that the cancellation of ALCC No. 717 is hereby approved; and BE IT FURTHER RESOLVED, that the Mayor is authorized to execute a Certificate of Tentative Cancellation and Certificate of Final Cancellation for ALCC No. 717. LEGAL DESCRIPTION OF AGRICULTURAL LAND CONSERVATION CONTRACT NO. 717 The legal description is as follows: The South 1/2 of the Southeast IA of the Southeast t/a of Section 23, Township 13 South, Range 19 East, Mount Diablo Base and Meridian. APN: 311-091-25 The contingencies and conditions specified in the"Certificate of Tentative Cancellation,"recorded by Instrument No. in the Official Records of the Office of the Recorder, County of Fresno, have been satisfied. CERTIFICATE OF 'TENTATIVE CANCELLATION NOTICE IS HEREBY GIVEN: By resolution dated August 17, 1993, the City Council of the City of Fresno granted tentative approval of the petition of Yoshiji Sugahara for cancellation of Land Conservation Contract No. 717, which applies to the real property situated in the City of Fresno, State of California, and is more particularly described on the legal description below. A Certificate of Cancellation of the contract shall be issued and recorded at such time as the following contingencies and conditions are satisfied: 1. Payment in full of the cancellation fee, which is in the amount of $137,500. 2. Unless the cancellation fee is paid, or a certificate of cancellation of contract is issued within one year from the date of the recording of this certificate, the cancellation fee shall be recomputed as the date of notice by the landowner to the City Council required by Government Code 51283.4.
