A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AWARDING
MULTIPRIME CONTRACTS TO COMPLETE REMODEL AND
INSTALLATION OF THE SAROYAN THEATER RESTROOMS BY
DECEMBER 31, 2006 (ALTERNATIVE BID "B")
WHEREAS, the Capital Management Division of the Public Works is currently working on
the renovation of the Fresno Convention Center Complex; and
WHEREAS, the City is planning to remodel and install restrooms at the Saroyan Theater;
and
WHEREAS, the City desires to bid this project with an accelerated time line for the remodel
and installation of the restrooms at the Saroyan Theater; and
WHEREAS, expediting the remodel and installation of the restrooms at the Saroyan Theater
may be of benefit to the citizens attending venues at the Theater and may maximize usage and
revenues generated; and
WHEREAS, in order to weigh the cost of expediting completion of the remodel and
installation of the restrooms at the Saroyan Theater, the City of Fresno invited bids (Bid File No.
2658-11017)on Alternative Forms for the remodel and installation of the restrooms at the Saroyan
Theater with either:
- Completion within ninety (90) working days, submitted as Alternative Bid "A"; or
- Completion by December 31, 2006, submitted as Alternative Bid "B"; and
WHEREAS, the City of Fresno received low responsive/responsible bid proposals for
Alternative Bid "A" in the aggregate amount of$755,000, and for Alternative Bid "B" in the
aggregate amount of$707,800; and
WHEREAS, pursuant to Section 1208 of the City of Fresno Charter and Fresno Municipal
Code Section 3-105.1(d)(3), the lowest bid shall be the bid price of the Alternative Bid selected by
Council after consideration of the amount of the bids received and the combination of work to be
performed when the Council finds an award to the responsive and responsible bidder to be either in
the best interests of the City or obtains for the public the best economic result.
NOW IT THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows:
1. The Council has received and considered the report and recommendations of City
staff, including the amount of the bids received and the combination of work to be performed and
anticipated impact of delay in project completion on facility usage and revenues generated.

2. The Council finds and determines that the benefit realized by expediting the
completion of this portion of the renovation project by December 31, 2006 at a cost savings
($47,200) outweighs the benefit of delaying completion at a cost increase ($47,200).
3. The Council finds and determines, based upon the facts set forth herein, that an
award to the lowest responsive and responsible bidders for Alternative Bid Form "B"for the
completion of the remodel and installation of the Saroyan Theater restrooms by December 31, 2006
is in the best interest of the City.

At the Council meeting of 08/29/06, Council adopted the attached Resolution No. 2006-412,
entitled Awarding multiprime contracts, complete remodel/installation of Saroyan
Theater Restrooms by 12/31/06 (alt. b), Item No. 9:15 a.m. H-2, by the following vote:

executing and dating your action. Please file the completed memo with the Clerk's office on

Saturday, Sunday, or holiday, in which case it has also been excluded. Failure to file this
memo with the Clerk's office within the required time limit shall constitute approval of the
ordinance, resolution or action, and it shall take effect without the Mayor's signed approval.
