HomeMy WebLinkAboutResolution - - 1994-171 - 7/19/1994 • S RESOLUTION NO. 94-171 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, AMENDING THE BULLARD COMMUNITY PLAN (PLAN AMENDMENT NO. A-94-01) WHEREAS, on December 20, 1988, by Resolution No. 88-462, the Council adopted the Bullard Community Plan; and WHEREAS, the Development Department has received an application from Robert McCaffrey to amend the land use designation of the aforementioned plan from office commercial to neighborhood commercial for 6 . 7 acres located at the northeast corner of West Herndon and West Spruce Avenues; and WHEREAS, said application also proposes to amend Policy No . 4 . 2 . 4-2 of the Bullard Community Plan in order to maintain internal consistency of the plan; and WHEREAS, the environmental assessment conducted for the proposed plan amendment resulted in the filing of a mitigated negative declaration; and WHEREAS, on June 22, 1994, the Planning Commission held a . public hearing to consider Plan Amendment No. A-94-01 and recommended adoption of the proposed mitigated negative declaration and plan amendment; and WHEREAS, on July 19 , 1994 , the Council held a public hearing to consider Plan Amendment No . A-94-01 and determined, based upon the testimony and information presented at the hearing and upon review and consideration of the environmental documentation provided, that the adoption of the proposed amendment is in the best interest of the City of Fresno . EFFECTIVE w "e I Dar ,,Y-5/61,591i ' / 7 / • • Resolution No . 94-171 A-94-01 Page 2 NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows : 1. The Council finds that there is no substantial evidence in the record that Plan Amendment No . A-94-01 may have a significant effect on the environment and hereby adopts the mitigated negative declaration prepared for this project . 2 . The Council of the City of Fresno hereby adopts Plan Amendment No. A-94-01, amending the Bullard Community Plan as follows : a . Change the land use designation from office commercial to neighborhood commercial for approximately 6 . 7 acres for the site as depicted on Exhibits "A" and "B" attached hereto and incorporated herein by reference. b. Amend Policy No. 4 .2 .4-2 to read as follows (new language underlined) : Retain commercial development within the undeveloped northwest portion of the Bullard Plan Area shall occur at the three commercial "nodes" of no more than fifteen acres each located at the following intersections : Polk/Sierra, Bullard/Dante, and Herndon/Hayes Avenues . The fifteen acres of commercial use may be developed entirely on a single corner of the intersection or may be developed on Mi €aOF L oel .3_40noe1J195 Alk Resolution No . 94-171 A-94-01 Page 3 two corners of the intersection as a ten-acre neighborhood shopping center and a five-acre accessory center or combination thereof . The fifteen acres located at the northeast corner of West Herndon and North Bryan Avenues and the 6 . 7 acres located at the northeast corner of West Herndon and West Spruce Avenues are exempt from this policy. 3 . The Council of the City of Fresno hereby grants temporary capacity for this property in the Cornelia Trunk Sewer for the project area .
