HomeMy WebLinkAboutResolution - - 1994-170 - 7/19/1994 • • RESOLUTION NO. 94-170 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO MAKING THE SECOND AMENDMENT TO RESOLUTION NO. 92-281 ENTITLED "A RESOLUTION OF THE COUNCIL O'F THE CITY OF FRESNO FIXING THE RATES OF PAY TO BE PAID TO CERTAIN SUPERVISORY EMPLOYEES OF THE CITY OF FRESNO ALLOCATED TO THE CLASSES SPECIFIED HEREIN, RATES OF PAY THAT ARE SUBJECT TO THE PROVISIONS OF THE SECOND PARAGRAPH OF SECTION 809 OF THE CHARTER OF THE CITY OF FRESNO" THE COUNCIL OF THE CITY OF FRESNO RESOLVES AS FOLLOWS: SECTION I. That the rates of pay to be paid to certain employees of the City of Fresno allocated to the classes specified herein which are subject to the provisions of the second paragraph of Section 809 of the Charter of the City of Fresno are established as provided in this resolution. SECTION II. Permanently appointed employees shall receive vacation accumulation in accordance with Fresno Municipal Code Section 2-1510; except, however, employees who have been continuously employed by the City for ten years or more shall accumulate vacation leave with pay at the rate of thirteen and one-third hours for each completed calendar month of employment. SECTION III. The following are the Holidays recognized by the City: New Year's Day (January 1) Martin Luther King's Birthday (3rd Monday of January) Washington' s Birthday (3rd Monday of February) Memorial Day (Last Monday of May) 4th of July (July 4) Labor Day (First Monday of September) Veterans Day (November 11) Thanksgiving (Last Thursday of November) Day after Thanksgiving (Last Friday of November) Christmas Day (December 25) Employee's Birthday Two Personal Business Days (8 hours credited to holiday balance on July 1 and 8 hours credited on January 1) Any day or part of a day declared by the Council, by ordinance or resolution, to be a holiday PASSED -M_324-Dad/5/45 EFFECTIVE— 8L/ 9 4 • SECTION IV. Prob. Job Period Code Water Distribution Supervisor I $26.43 an hour 1 year S 18 Hours of Work: The regular work week shall consist of 40 hours, Monday 8: 00 a.m. through Friday 4 :30 p.m. , and the regular work day shall consist of 8 hours, Monday through Friday between the hours of 8:00 a.m. and 4 :30 p.m. , with a lunch period of one-half hour, between 12 o'clock noon and 1: 00 p.m. Overtime: For any extra time worked up to a total of 2 hours after the regular 8 hours have been worked, Monday through Friday, time and one- half the straight time rate shall be paid. Time and one-half shall be paid for the first 10 hours of overtime worked on Saturdays. Double time shall be paid for all overtime worked after the first 2 hours of overtime on a regular work day, and after 10 hours on Saturdays, and for all time worked on Sundays and holidays. Show-up Time: Any worker reporting for work at the regular starting time and for whom no work is provided shall receive pay for 2 hours at the prevailing rate of wages unless notified not to report, and any worker who reports to work and for whom work is provided shall receive not less than 4 hours pay and if more than 4 hours are worked in any one day, shall receive not less than a full day's pay. However, the exception shall be when weather makes it impracticable to put such an employee to work or when stoppage of work is occasioned thereby or when a worker leaves his/her work of his/her own accord. SECTION V. Prob. Job Period Code Electrician Supervisor I $22 .86 an hour 1 year U 48 Electrician Supervisor I 's working on poles at a height of 75 feet of more, on towers at a height of 100 feet or more, on other than a tower erection, shall receive double time rate of pay for all such time worked on such heights . Thirty minutes or more of such work shall entitle the worker to the premium rate for that half day. Work performed in trees "exp 324 nate t/5/R5 • • shall receive time and one-half up to 60 feet. Work in excess of 60 feet, double time. Hours of Work: Eight hours between the hours of 8: 00 a.m. and 12 : 00 noon and 12 :30 p.m. and 4:30 p.m. shall constitute a work day. Forty hours work within 5 days, Monday through Friday inclusive shall constitute a week's work. Working hours may be changed to conform to weather conditions. Overtime: Work performed on Sundays and holidays shall be paid at double (2x) the straight time rate of pay. Work performed outside of regular work hours on work days and on Saturdays, shall be paid at one and one-half times (1-1/2x) the regular straight time rate of pay. Emergency calls outside of regular working hours - a minimum of one (1) hour at overtime rate or if called out double (2x) the straight time rage of pay. Time to include from shop to job and job to shop. Show-up Time: When workers are directed to report on a job and do not start work due to lack of material or other causes beyond their control, weather excluded, they shall receive 2 hours pay unless notified before 7: 00 a.m. Shift Differential: When so elected by the City, multiple shifts if at least five (5) days duration may be worked. When two (2) of three (3) shifts are worked: DAY SHIFT - The first shift shall be worked between the hours of 8: 00 a.m. and 4 :30 p.m. Workmen on the day shift shall receive eight (8) hours pay at the regular hourly rate for eight (8) hours work. SWING SHIFT - The second shift shall be worked between the hours of 4 : 30 p.m. and 12 :30 a.m. Workmen on the swing shift shall receive eight (8) hours pay at the regular hourly rate plus 10 percent for seven and one- half (7 1/2) hours work. GRAVEYARD SHIFT - The third shift shall be worked between the hours of 12 :30 a.m. and 8:00 a.m. Workmen on the swing shift shall receive eight (8) hours pay at the regular hourly rate plus 15 percent for seven hours work. A lunch period of thirty minutes shall be allowed on each shift . All overtime work required after the completion of a regular shift shall be paid one and one-half times the "shift" hourly rate. j5rtS S�� • • There shall be no pyramiding of overtime rates and double the straight time rate shall be the maximum compensation for any hour worked. There shall be no requirement for a day shift when either the second or third shift is worked. SECTION VI. Prob. Job Period Code Stone Mason Super- visor I $22 .98 an hour 1 year T 99 Hours of Work: Eight hours per day, 5 days per week, Monday through Friday inclusive. Overtime: Work done before 8: 00 a.m. and after 5:00 p.m. and on Saturdays and Sundays shall be considered overtime and shall be paid at the rate of double time. Show-Up Time: Any worker required to report on the job and not put to work shall be paid two hours show- up time, inclement weather excepted. Any worker who works after 10: 00 a.m. and is then dismissed, shall be paid for a full half- day. An worker working after 3 :00 p.m. who has commenced work at 8 : 00 a.m. of the same day shall be paid for a full 8 hours, unless the lay-off is due to the lack of material due to causes beyond the control of the City of Fresno. SECTION VII. Resolution 92-204 and all amendments thereto and all other resolutions or parts of resolutions in conflict with the provisions of this resolution are hereby repealed. SECTION VIII.
